County court judge Jill Levy Zooming along …

Despite glitchy technological issues on top of the difficulty of judging credibility in normal court proceedings, the lack of real-time client interaction, and the potential for unethical witnesses to exploit the shortcomings of remote testifying, at least one Broward judge has started setting Final Violation of Probation evidentiary hearings over objections on Zoom.

Accordingly, on the heels of David Ovalle’s Miami Herald article reporting similar issues in circuit court proceedings in the 11th Circuit, we reached out to FACDL Miami’s Dan Tibbitt, who is handling matters pro bono at the Third DCA following Miguel de la O’s Order Overruling Objection To Zoom Probation Violation Hearing.

Tibbitt explained the Miami judges have stayed all Zoom probation violation hearings until the DCA rules, and doesn’t believe any judge across the state has held one to date over objection. In the meantime, FACDL wants to be kept abreast of other judges who may be setting them without agreement of the parties, so be sure to drop Dan a line with your case number and judge if you’ve got a qualifying matter.

    I disagree with Judge De La Os order, but I am impressed with it anyway. I’ve become so accostumed to the morons on the Broward bench that I forgot what a well written order looks like. So I say bravo to the judge and hope the DCA reverses him.

    The judge has never met Mr. Clarington in person. All the judge has seen is a black face on a virtual monitor, sitting in the Dade County jail. The court proposes to hold a virtual hearing to decide whether to keep Mr. Clarington in a cage for the rest of his life. The writ should issue to prevent such a hearing.

    The Sun Sentinel has made it clear.

    With the Murphy and Bailey endorsements, they have proven they like the current situation as it is. Their lip service about change is a lie. A big one. In a county with a 4th estate, a JQC offender with a disrespectful attitude would have been drummed out long before an election. Here, there’s no chance but for the voters to enforce positive change and a Bench reflective of the community it serves.

    This is a momentous occasion to vote for a distinguished and honorable citizen like Mr. Odom. He will bring dignity to an office where the current occupant has brought scandal and shame. Mr. Odom will not bring the JQC to Broward. He will bring honor.

    Diversity is a factor in modern life. The Sun Sentinel likes its judiciary being 80% White, like the Editorial Board. Locking up Blacks. Disproportionately. Broward should have a judiciary reflecting the makeup of the citizenry of the County, even with an Editorial Board trying with all it’s might to keep the minority population unrepresented proportionally on the Bench.

    This is momentous. It’s time to write a check for George Odom. To bring Broward County forward. Vote and support Odom, and make history for positive change.

      Its EAZY. Gordon Weekes will do even less than Howard Finkelstein. Both have been an embarrassment to the Office of Public Defender.
      Weekes spends his time hiding with his head in the sand and Finkelstein has been playing golf the last several years with the only people really suffering being our clients and the quality of the representation they receive.
