    So the lead attorney will ask for a justification and if they don’t agree they say no. Each individual ASA should have their own discretion to prosecute their cases how they deem appropriate. In theory they know the case better than anyone else. A second needs to ask a lead to break down a possession with intent to simple possession. Good start but let’s see how this plays out.

      This new policy is a good one. The leads are generally attorneys with about 5 years experience. Enough experience to be able to make discretionary decisions. A 3rd generally has only 2 years experience (and a 2nd generally starts with about 3 years experience) so it is reasonable to expect them to have to discuss a disposition that isn’t within guidelines with someone with more experience. Chasing down a supervisor shouldn’t be necessary when the leads are in court everyday and know the guidelines, the judge’s usual dispositions, the 2nd and 3rd attorneys work, and have the experience to make discretionary calls. Be critical where criticism belongs (like Pryor keeping Satz on Parkland or keeping any of the double dippers like McCann).

        Counsel has authority to dismiss upon receipt of complaint. But if the allegations, taken as true, would = a rule violation, then attorney rqd. to respond (i.e. Probable Cause)

        If something isn’t outright dismissed, then the attorney has to go through stress of a reply, hire counsel, etc.
        From what I know of her, she deserves it.

    The worst mistake Broward voters made was not electing SarahNell Murphy as State Attorney. Harold Pyror should be embarrased that he believes he is more qualified or better suited for the job. He sees it as a stepping stone for some grand political ambition while she saw it as a career where she could make a positive impact and contribution to her community. Ask any judge or lawyer in Broward their opinion of her and you will appreciate the loss the county suffered.
