Oh Joel! click here for the letter from Howard Finkelstein to Jack Tuter regarding Joel Lazarus’ comments during First Appearances court on January 19th.

The Public Defender is looking to have Lazarus stricken from any further criminal matters, after the senior judge was caught on tape stating “I’ll double the bond … [the alleged incident] took place in my neighborhood. Closer to my house, the higher the bond. That was always Lazarus’ Rule.”

Additionally, Finkelstein highlights what he calls “two policy statements (as to bonds and as to sentencing) that would place any reasonable defendant appearing before him in fear of not receiving a fair and impartial hearing“.

From the letter:

During the afternoon 2nd look docket, Judge Lazarus further showed his lack of impartiality when dealing with a defendant facing a misdemeanor cannabis allegation … Even though the case had not been filed, the defendant wished to resolve his case so he could be released from custody. Judge Lazarus offered to resolve the case for an adjudication and time served. When asked if he would withhold adjudication, Judge Lazarus stated “absolutely not, I don’t do that.” When challenged with the information that other judges typically withhold adjudication in misdemeanor cannabis cases, Judge Lazarus advised that he does not, and that he would “treat him consistent with the way I treat other defendants.” These additional policy statements evidence an antiquated sentencing approach to cannabis that is at odds with our county, state, and nation’s evolving attitude and show that with him, criminal conviction is the only resolution.”

Now all eyes are on Tuter to see how he handles a seemingly out of touch senior judge who has, for whatever reason, been permitted to work pretty much full-time since retiring many years ago …

From the DBR – speaking of Tuter, after many strides into the modern era since taking over as chief judge, he still shares one thing in common with his predecessors: he hates this blog!

The Daily Business review quotes him boasting from the State of the Circuit address on January 19th, ironically the same day Lazarus was stuffing foot in mouth in bond court:

“And now the chief judge wants to turn his attention to several new initiatives with Broward Clerk of Courts Brenda Forman, Public Defender Howard Finkelstein and State Attorney Michael Satz, despite what he called “malicious and anonymous blogs” that falsely depict a rift among the public officials … “

On the bright side, with our slower rate of posts and news reporting, it’s nice to know he’s still reading, even if it’s not very carefully …

    The video was first posted in the comments here. That’s how it was seen. Maybe that’s why Judge Tuter is mad. But anyway, who was the ASA who said he has no problem with what the Judge said about doubling bonds?

      Why would Tuter be mad because there’s a place that people can post things and expose problems with the judicial system? The person that busted the Lazarus case is an American hero. If the poster hadn’t found it and out out it on the message board then it never would have been discovered and injustice could have happened if in fact the mentioned bond was doubled due to judicial geography. I don’t know why Tuter says things like this but it is so obvious that blogs like this are so needed in these dark times.

          Make Public any and all Case Appointments by all Broward Judges. Restore confidence to a severely damaged Broward Judiciary by coming clean on Pay to Pay schemes emanating from the bench.
          The coverup is as bad if not worse than the breach of ethical obligation to the Public.

              It’s inconceivable that Chief Judge Tutor has not taken swift and decisive action to remove Lazarus from first appearance court under the circumstances outlined in Howard Finkelstein’s letter.
              One could say that Tutor is getting off to a very bad start after becoming Chief Judge of a Circuit plagued by poorly performing and corrupt broward judges.
              It looks like much of the same indecisive and incompetent leadership that was exhibited under Former Chief Judge Weinstein.
              Tutor is proving to be the same.
              When is the Broward Judiciary going to clean up its act?
              Looks like voters are going to have to solve the problem by voting them all out of office and replacing them with responsible judges who take their jobs seriously.

    Talk about draining every possible dollar out of the system and still being an ungrateful old man.

    That money could have gone to hard working, deserving employees – but he doesn’t care.

    He probably sleeps in his black robe. Wearing the robe and having people pretend they respect him are the only things that keep his heart beating. And what would attorneys like Stuart do without the special treatment he gets in foreclosure court from Lazarus and the others in the courtroom that he pays off.

    It would be great if JUDGE FRUSCIANTE came back. He is respectful to everyone and all litigants would get fair treatment before him. This is a man who actually cares about his community and profession

      The chili pepper routinely cancelled all his afternoon dockets after first making lawyers and litigants wait for an hour or two.

    This is the problem with Broward judges—FloridaBulldog article about Sarasota Tribune unequal sentencing:

    Recently retired Judge Thomas M. Lynch IV is one example. The registered Democrat was one of the youngest judges in the state when elected to the county bench at 33 in 1984.

    But Lynch’s sentencing patterns don’t always fit his surfer persona.
    Since 2004, Lynch handed down an average sentence of 155 days to white defendants across third-degree felonies, an analysis of OBTS data collected by county clerks shows.
    He gave blacks more than double the time. He locks up blacks with identical charges and records for more than double the time.
    The judge also sentenced whites to an average of 163 days for burglary, while giving blacks 247 days, despite the defendants scoring the same number of points at sentencing.
    And Lynch sent away whites for an average of 100 days in lockup for felony drug possession, while giving blacks 140 days.

    “It’s a question of being fair versus being punitive,” said Marit Rehavi, an economics professor at the University of British Columbia, who studies racial discrepancies in sentencing. “We may help minorities most not by increasing fairness, but by reducing the punitiveness of sentencing.”

    If a joke he needs sensitivity training.

    If it was doubled it could be a JQC complaint and removal.

    All in all doesn’t the Sr Judge all serve at the C Judges’s pleasure?

    Certainly there are better choices of retired Judges for Judge Tuter to choose from after viewing this behavior.

        Satz is the one who protects the community- versus Finklestein who represents Indigent defendants. It’s not Finks job to fix all the wrongs of the justice system. Any lawyer, Judge or litigant can do that.

    Like it says above, I wonder if he actually doubled the bond of the defendant from his neighborhood. If his so-called Lazarus Rule is real then the JQC needs to bounce him and Tuter needs to review any case he has presided over last year to make sure others aren’t still in jail over the Lazarus Rule.

    This double dipping schmoozing Broward Judge needs to hit the road. He’s one of the last scumbags to leave his trail of slime all over the Broward Courthouse.
    And Finkelsteinneeds to put his money where his big mouth is and file a formal complaint with the Judicial Qualifications Committee, not leave the cleanup of this to a bureaucrat like Tutor whose only aim is to downplay the outrageous behavior of crooked, unethical and corrupt Broward judges.
