    Very interesting. It looks like Dayonte Resiles and George Odom Jr., the attorney representing one of his co conspirators, Kretron Barnes, got their wish to have Singhal recused from the case. How is it Resiles letter to Singhal was not grounds for contempt of court and how did the letter mysteriously make its way to the press. Someone at the courthouse has loose lips.

      Agreed. We know someone who was the alleged victim in a domestic violence case a few years back. Without hearing details, people that knew what bullshit this case was against her husband advised her to write the judge a letter. She worked before for a well known criminal defense law firm.
      Here’s what she did instead
      Get ready for it, we’ll bet you as defense attorneys didn’t know you could do this:
      She filed a motion with the clerk of the court to dismiss.
      Get it! The victim filed a motion to dismiss.
      What this did, instead of the judge not reading a letter sent to his office, he started reading the “Motion aloud in open court.
      Once he did that the state was screwed as he was forced to call her as a witness, take testimony which totally contradicted the prosecutions witness only the officer. What really pissed her of is this Fort Lauderdale police officer kept saying “wow my first night on duty and I get to arrest someone. That and when she wouldn’t co-operate with him he became enraged, threw his clipboard on the table then called EMS, not to get her medical attention, which she did not need, but to try to have her BACKER ACTED! thankfully EMS wasn’t playing that game for police.

      The Civil boys weren’t going to swallow her circus act no way. She was bumped out quickly with no fanfare, no nothin. You want to see an act like that there’s always the flea market on weekends. Nobody’s going to put up with that mouth if they don’t have to. When is her term up ? Guess the fantasy of becoming a federal judge fizzled out once reality set in.

    All those open seats in 2018 means the incumbents that get challenged will be swallowed up in a sea of judicial candidate confusion and will likely lose if they have weak names. Lawyers need to coordinate their attacks on the lousy Judges and take them out in August or November like Destry got done.

People should feel sorry for the victims of his egregious behavior instead of pitying the pathetic Broward judiciary and its most recent disrobed clown.           The JNC doesn’t have the resources to verify everything on the applications. There are no background checks by any agencies. Tax returns are not submitted. There’s a single quickie interview locally and one up north. There’s even less oversight for a candidate filing for election because there’s no official vetting process for someone running and the news media ignores judicial races in most cases. It’s ridiculous. At the very least, JNC applicants should have to undergo thorough background checks by FDLE since they are hoping to serve without a mandate by the electorate.

      A criminal investigation needs to be done by the sheriff as far as if these activists he met with may have bribed or tried to bribe an elected official, and if Destry participated in any way. Maybe he was just trying to protect his pension, or has any previous judge in the past taken the fifth in a JQC hearing?

      In my experience, I have seen attorneys, judges, and the staff of the clerks of the courts all commit fraud upon the court, and there was at the very least a conspiracy between the judges and the clerk of the court’s office.

      All of this was part of unconscionable schemes designed to improperly influence the courts in their decisions.

      In my cases, there was fraud; there was fraud on the court; and there was a conspiracy to defraud. This fraud was intentional. The fraud was perpetrated by officers of the court.

      Herring, 424 F.3d at 386. A judge is an officer of the court, as are all members of the Bar. A judge is not the court. People v. Zajic, 88 Ill.App.3d 477, 410 N.E.2d 626 (1980).

      In my cases, the fraud was directed at the judicial machinery itself. The fraud subverted the integrity of the courts. The fraud was designed to deceive the courts into believing facts that were not true. The courts were unable to adjudicate the matter properly because the courts were influenced by false information.

    In Bulloch v. United States, 763 F.2d 1115, 1121 (10th Cir. 1985), the court stated “Fraud upon the court is fraud which is directed to the judicial machinery itself and is not fraud between the parties or fraudulent documents, false statements or perjury. … It is where the court or a member is corrupted or influenced or influence is attempted or where the judge has not performed his judicial function — thus where the impartial functions of the court have been directly corrupted.”

    “Fraud upon the court” has been defined to “embrace that species of fraud which does, or attempts to, defile the court itself, or is a fraud perpetrated by officers of the court so that the judicial machinery cannot perform in the usual manner its impartial task of adjudging cases that are presented for adjudication.” Kenner v. C.I.R., 387 F.3d 689 (1968); 7 Moore’s Federal Practice, 2d ed., p. 512, ¶ 60.23. The 7th Circuit further stated “a decision produced by fraud upon the court is not in essence a decision at all, and never becomes final.”

    It is also clear and well-settled law that any attempt to commit “fraud upon the court” vitiates the entire proceeding.

    I’m never getting moved from the criminal bench because I belong here, even when I make off handed comments about cases, rule incorrectly and generally do not know the law or judicial cannons. There is no way I am going to be run against in 2020 I have it in the bag.

    The ones that go for histrionics and other inappropriate self-indulgences need counseling to recognize what everyone else already knows, specifically that their dysfunction is typically caused by a baseless exaggerated sense of self-worth subconsciously generated in a futile attempt to bury the gnawing inner truth that most of them couldn’t even earn a piss poor judicial salary whilst practicing law, and therefore they’re incapable of dealing with successful individuals day in and day out whilst keeping their inferiority complexes in check. Admitting there’s a problem is the first step on the road to recovery but its a hard road. There should be support groups in fact, given the other issues with Broward, like drug and alcohol dependence and telling the truth whilst under investigation.

    Bailiff problems down in Miami, too. A 3-week trial down there just ended in a mistrial due to bailiff misconduct with the jury. Judge’s name is Millan. Maybe Broward can send him one of their soon-to-be fired BSO bailiffs. These guys just don’t know what they’re doing.

      In my opinion, with regards to judicial races, being left off the Palm Card is irrelevant as those contests are non partisan in nature and when you cast a vote for judge its not because they are a republican or democrat its because of their experience and qualifications. Do you see democrat or republican after judicial candidate names when casting a vote for judge? Just saying.
