DOUBLE DUMPED?

Rumor has it the fates of the double dippers handling the Parkland case and attendant issues are in limbo. Apparently, one of the still working pensioners, Tim Donnelly, has been told he won’t be coming back in January, ostensibly due to budgetary concerns.

Concerning Mike Satz, Jeff Marcus, and Carolyn McCann, the remaining expensive and retired prosecutors looking to essentially stay employed ad infinitum given the pandemic and breadth of the Cruz case, many are hoping budget cuts and morale concerns within the ranks of talented, full time and decidedly unrecognized SAO employees will cause Harold Pryor to rethink his position on keeping the rest of the old guard in place, and at the center of an intense media spotlight for possibly years to come.

Our position hasn’t changed since Bob’s piece, while Pryor seemingly flip-flopped during the campaign as to whether or not Satz and company would be staying on if he won. Now, factoring in a looming budget crisis, let’s hope Harold ultimately makes a clean financial and symbolic break from the past, and spreads the savings, large or small, amongst his loyal, skilled, and underpaid ASA’s, who most definitely deserve to be appreciated and rewarded for their years of dedicated service …

I remember he wasn’t very bright and pretty lazy when it came to doing anything actually. A polite enough guy. Now he’s in the green after winning and wants to change things with letting people go for budget reasons but still wants to pay the former piper big bucks to try a case really anyone could try ?
      I don’t know, but his new admin is starting to look like a failure on a few different levels and he’s barely begun to take the reins.
      Broward has enough face cards. What we need is leadership. The last time I looked this included experience and courage, not political patronage. We certainly have enough of that to go around. Very disappointed so far.

    Pryor doesnt need to keep any of the double dippers. All he needs to do is look at the LONG list of very talented, hardworking, previously underpaid, ASAs who left in the last 4 years (since Satz got re-elected in 2016) and invite them back with reasonable salaries for their experience and skill– he would bring back tons of experience and talent while saving money and at the same time ensuring (since they left because of Satz) that his new crew wouldn’t be loyal to the old administration. I can think of a dozen former ASAs he should be calling.

    That’s obviously illegal, right?

    Nope. It seems the thirstiest of Florida’s trough-drinking bureaucrats have found a loophole in the law that the state is allowing them to use. Though McCann is being paid the $112,500 in taxpayer money, she’s technically employed by a pass-through private company based in St. Augustine called SS Solutions. Satz has arranged to pay that company $133,500 per year, which then funnels money to McCann, minus the firm’s $21,000 fee for the trouble.

    And it only gets worse. In the next several months, three other top employees — chief prosecutor Jeff Marcus, executive director Monica Hofheinz, and corruption/special investigations chief Tim Donnelly — are all retiring (on paper anyway). All three of them make the office’s max salary of $170,000, and Satz has approved all three to immediately return on private contracts after collecting their lump-sum payments — which total $1.17 million among them — through the state’s Deferred Retirement Option Program (DROP), in addition to pensions totaling $243,648.48 a year for the rest of their lives.

    It all started back in January when assistant public defender Jennifer Edgley was in the judge’s courtroom.

    “All of a sudden I hear her yelling at me and what she does is, she looks at me and says ‘you, you little twit,’ and I turned around absolutely shocked that she was speaking to me in that manner,” Edgley said.

    The public defender also claims the judge recently called a defendant in her courtroom “an idiot” and “stupid.”

    Well look at Saturdays first Appearance Court that Judge Levy-Cohen presided over. More important look at the comments from the public at large about her. Most say she should be allowed to hear criminal cases and worse. She tells defendants and attorneys they have limited time for motions but then goes and BS talks about personal things with court staff.
    Not good at all. Mirroring what Howard said about her in 2017. Why not give it another try?

      This Judge should NEVER perform a magistrate hearing EVER AGAIN!! I have seen some judges come in for weekends and days off replacements that I thought were maybe not the best pick but holy moly! This is absolutely outrageous!!       With all due respect: This judge has No experience doing this, and is very hesitant to do anything that a PD asks her to do, and denies PTR to people asking for it. She sets bond too high, or ignores people in the line. If you can’t come up with $$$$$, that’s what PTR IS for. I wouldn’t WANT to appear in front of a judge that will “Have another judge deal with it”. I would INSIST that I go to division. I would tell my judge that first appearance is useless, because no one can “deal with” any of my charges, and they set ridiculous bonds.

      The reason I feel this way is because there was a “no bond hold” that should not be there, and even though there is EVIDENCE to support that, a lawyer has to argue that Judge Seigal wrote an order, and the out of state hold should be lifted, and seigal deals with these.

      When will there be a judge that actually has the ability to deal with these cases? Is it the fault of the accused that they have to wait so long?

      This Judge is so DIS organized, and because of this, she can’t seem to read charges correctly, or to make appropriate decisions. She is mixing up the clerk, the Pretrial office, and the PDS. Doesn’t seem that the State or PDS respond when asked. I wish the PDS could actually HELP these people, but VOPs and No Bond Holds, and capias issues make the 1st Appearance Court useless.She also forgets to find PC BEFORE attaching bonds, and it is confusing.

      Judge Murphy used to do most weekends before covid. He was great. Fair and tried to give a lot of time served to lower level misdemeanors and pre trial release for non-violent felonies. This Judge is awful and when you watch her and some others it makes you wonder how some of them get elected.

    Dear Colleagues,
    I want to thank you for all of the lovely messages of encouragement and well wishes you have sent to me since I was told that I will not be sworn in on January 5th
    as an assistant state attorney, under the new administration. I also want to let you know not to worry about me. My future is bright and I leave the office proud of my accomplishments and fulfilled in every sense of the word. I have been an attorney for 40 years and an assistant state attorney in this office for 34 consecutive years. This is my home and you are my family. I love this job and our office. I truly wish the new administration success in continuing our mission. It will be difficult and they will need your help. Too often, people forget what our mission is. It is the opportunity to advocate for true victims of crime by trying meaningful cases we will never have the opportunity to try anywhere else. I’ve spent the past few days notifying victims and their families on some of my cases of my imminent departure, and I can tell you we do make enormous differences in their lives.
    I know the transition is difficult for a lot of people. Change can be challenging. Many of you have expressed to me disbelief and confusion that I will not be sworn inon January 5th.
    Thank you for your friendship and confidence, but I’ve accepted that decision and have moved on. It is the new administration’s prerogative to hire whomever they want to hire. They do not have to give reasons for their decisions. It’s a political office and Mr. Pryor will be the new state attorney. He, and he alone, will set the policies and procedures for his office that his assistants will follow. I wish him well.
    Many people have been contacting me and telling me the reasons they are hearing and are being told why I will not be sworn in. Sadly, I think, if that is what they are hearing and are being told, then there is a huge misunderstanding. Just for the record: I did not turn down any offer, whether it was $120,000 or $80,000. None was made to me. It maligns my reputation and integrity to suggest that I would be such a cad to turn down such generous offers. I also did not refuse to take the Training Division or any other position. The Training Division was never offered to me. If it had been, anyone who knows me knows I would have jumped on it. Lastly, I never said I wouldn’t try a case. That’s a longer explanation that I see got lost in translation. However, it doesn’t really matter what the reasons are. I was told numerous times they wanted me to stay, and then I was told I wasn’t being sworn in because of the budget, and that I could make more money in private practice. Clearly, people do not know my passions or what makes me tick.
    I truly am not upset or bitter about the new administration’s decision. I know we can all be replaced. I am a more forward looking person and I want the office to succeed, especially after I have left. I am leaving some of the most serious cases I have ever handled in my 40 year career. They require a lot of attention and an enormous amount of work. I do ask that whoever takes over these cases gives the victims the voice they deserve.

    The time has come for me to say my goodbyes and it is very sad that this pandemic prevents me from doing so in person. I will truly miss our office events such as expungement workshops, group photos in pink and holiday donations. Thank you to all of you who contributed to making these events so successful. But, mostly I will miss the times when you appeared in my doorway and said ‘Got a minute?’ Of course, it was never a minute but we ended up solving the problems of the world!

    Due to this pandemic the entire state is experiencing an economic crisis. Every state agency is facing major budget reductions . I am very hopeful that our early hiring freeze and reducing spending will help get our office through this as it did during Florida’s economic crises of 1992 and 2008. Those of you who were here then remember that together, working as a team, we were able to keep the office operational. I know you will give Mr. Pryor and his new Administration the same support until the State recovers.

    No officers convicted by Iowa AG in force cases since 2004

    IOWA CITY, Iowa – When cops pulled over Marquis Jones for loud music one sunny afternoon in October 2017, the 27-year-old Black man got out of his car and ran.

    Jones escaped one officer’s tackle and carried a handgun as he fled through a neighborhood in Burlington, Iowa. Police yelled for him to drop his weapon before Officer Chris Chiprez fired seven times, missing Jones. Jones ditched the gun, ran down an alley and into a backyard, and laid on the ground as Chiprez pursued.

    Chiprez said he shot and killed Jones after he started to rise and made a hand movement. Relatives say Jones, a father of five, was trying to surrender.

    To determine whether Chiprez should face charges, authorities turned to Iowa Attorney General Tom Miller, a Democrat and the longest-serving attorney general in U.S. history, with four decades in the role.

    Like more than 30 other cases involving force used by police since 2004, Miller’s office soon cleared Chiprez of wrongdoing, according to documents obtained by The Associated Press through an open records request.

    A state prosecutor concluded Chiprez had a reasonable belief that Jones was armed and dangerous when he fired the fatal shot. He rejected claims that the officer knew Jones had dropped his gun, which was later found about 50 yards (meters) from his body.

    Police officers are not often charged when suspects end up injured or dead. Laws give them the benefit of the doubt for a dangerous and unpredictable job, and juries are reluctant to convict. But prosecutors who have histories of declining to charge police are facing more scrutiny of their records, particularly following a summer of mass protests calling for accountability.

    That dynamic has emerged in Iowa, where lawmakers in June gave Miller new power to investigate such deaths even as some of his office’s previous rulings backing police have disappointed families and civil rights lawyers.

    The AP found that Miller’s office has not convicted an officer for improperly using force in at least 16 years, the earliest date for which records were available. It pursued charges against two officers out of 35 force cases reviewed, and both were ultimately acquitted.

    The attorney general’s office closed 31 other cases after determining the officers’ actions were justified and sent two other cases to grand juries that did not return indictments.

    Linn County Supervisor Stacey Walker, a leading voice for racial justice in Iowa, said the AP’s findings demonstrate that the criminal justice system is “not only racially biased, but catastrophically broken.” He said it was time for a new generation of prosecutors who are more reform-minded.

    “When police officers kill innocent people and face no consequences or avoid prosecution altogether, it encourages bad behavior and further corrupts our criminal legal system. This has to change,” Walker said.

    She has been contacting us asking we take her name off of our website because she claims it has been expunged. She said a prospective employer would not hire her because they saw it.
    That’s not going to happen.
    Boo-Hoo. Maybe she shouldn’t commit felonies while employed as a LEO.

    We are just curious what it was she did to get 3 years probation.
