Jackie Powell has been served for deposition next week, December 27th.  She’s a witness named by Brenda, and is essential to clarify exactly what happened on the public walkway connecting the courthouse to the garage on December 12th.

Oddly enough, Powell doesn’t want to be deposed.  Despite being an incoming judge charged with upholding the law, this particular search for the truth and justice doesn’t seem to interest her.  Her office said she wouldn’t be cooperating, and on Friday one Chesterfield Smith, from the Office of the Attorney General all the way up in Tallahassee, spoke with Ed Hoeg to make it clear he would be attempting to obtain a protective order.  If Smith can’t get one issued in time, he said Powell would probably no show.  Strange indeed.

As for the other depositions, Brenda, in her capacity as Clerk, has not responded to repeated attempts to coordinate dates and times that her named employee witnesses will be available.  Subs on that will therefore be issued based on Hoeg’s schedule shortly, as Bill Altfield’s office has suggested a hearing date of February 1st in Broward County.  Requests from Altfield’s and Charles Canady’s offices to hold the hearing in Miami were, of course, politely declined, as we strongly feel what happens in Broward must stay in Broward, so as many interested people as possible can personally bear witness to the actions and complaints of one of their elected Constitutional Officers …

SUN SENTINEL – BRENDA FILES COMPLAINTS AGAINST LAWYER

… Forman later claimed in an email to the South Florida Sun Sentinel that an article about the dispute would unfairly incite “racism, hate and bigotry toward me and my employees.” She asserted that the information in her domestic violence complaint is “confidential” and “protected.” The complaint can be accessed by any member of the public on computers located on the first floor of the Broward courthouse. She did not return a phone call and email seeking comment.

      Are you saying Powell shares space with the same Barbara Heyer that complained about the blog, who is married to a very good friend to Judge Diaz (and a former Judge), the same Judge Diaz that is married to Dian Diaz the Clerk’s witness, and the same Judge Diaz that also featured in complaints about the blog a while ago? And Powell doesn’t want to testify? Say whaaaat?

    Potential no show? If the attorney general can represent her before she takes the oath wouldn’t that also mean the Jqc has jurisdiction if she blows off a subpoena without a protective order being in place?

    I’m sure Judge Powell, the Assistant AG, and whatever Broward Judge gets saddled with the Emergency Hearing over Christmas because of Madam Clerk sticking Powell into this are happy.

    One of the most telling things about Brenda’s public meltdown is that when she was contacted by the Sun Sentinel for comment, she then proceeded to try to persuade the reporter from reporting on the incident at all by claiming it was private and would subject her and her employees to further problems like the expression of racism and further criticism. This, after getting several statements from various employees to support her claims of being somehow threatened. One of which is Judge Diaz’ wife who is well known to have a ongoing gripe against Mr. Gelin.

    This is really about an office that is one of the most poorly run offices in the state.

    She invents an incident that has no substance in fact, but, worse, then tries to gloss over her strange and incompetent behavior by using her race as an excuse not to report it.

    Very strange indeed for any kind of public official who isnt suffering from some kind of persecution complex and or agenda.

    It leads one only to speculate on who is advising her. One doesnt really have to look very hard to come up with that answer.

    Jackie Powell isnt starting off very well.
    Start preparing a JQC complaint even before she takes the bench along with a Bar complaint.
    There’s no reason why she can’t be subpoenaed under the circumstances as she was a witness to the alleged event that has given rise to this action and has required the CJ of this circuit to request a judge hear this matter from outside this jurisdiction.
    She takes the County Court Bench when?
    She want’s to play hardball so teach her the lesson now that she has to play by the rules.

    Honestly. A deposition is when one discusses what they saw under oath.

    Like they only have to to tell the truth about what they saw and what they rembered.

    Why for fuck’s sake would anyone have a problem with doing that.

    Why for fuck’s sake would the government agency charged with law enforcement across Florida want to help her from having to testify to the truth?

    Judges are poorly paid but to most of them it’s a windfall. They couldn’t make it in private. No way. Bureaucrats. That’s apt.

      I’ve called her Brenda since she took over the clerks office from Howard and have had no problems. Now I’m leaning toward just calling her incompetent.
      This has more to do with Diaz’ wife and Diaz than it does a boob of a clerk like Brenda.

    MONTHS BEFORE THIS BRENDA FORMAN COMPLAINT DIAZ TOLD A SUN SENTINEL REPORTER IN A COURTROOM HE WAS PRESIDING OVER THAT HE COULDNT TAKE HIS PICTURE
    LATER DIAZ APOLOGIZED TO THE CHIEF JUDGE FOR HIS BEHAVIOR STATING HE DID NOT RECOGNIZE THE SENTINEL REPORTER EVEN THOUGH HES KNOWN THIS REPORTER FOR YEARS

    DIAZ AND FORMAN NEED TO BE RELEGATED TO LAWN CHAIRS IF THEY DONT KNOW THE LAW

      Its never good to see how sausage is made, but Brenda Forman has not done herself, her employees, Jackie Powell or Dian Diaz any good. They all look like fools.
      This will cost Powell when her first term as a newly minted Broward judge is up as I’m sure someone will run against her and beat her for the county spot. Jackie has messed up before she even puts on the robe.
      Apparently Judge Diaz doesnt care who gets caught in the crossfire of his impotent attempts to cause problems.
