FINKELSTEIN: SUBSTANCE OVER FORM

In anticipation of the May 18th courthouse “soft opening,” Howard Finkelstein has sent the following letter to Jack Tuter.

Essentially, without real time, confidential communication with clients, the PDO will not be agreeing to anything further being handled by Zoom that isn’t release based or case management. Most of the letter is below, and the full text is here with case law cites …

Good for Howard. He is spot on with this issue. Effective communication during a hearing is essential. I often lean over and will whisper or write something to my client during testimony.

Let’s face it. Some of the County Judges can’t even handle doing a bond hearing on a day not reserved for bond hearings. How are they going to manage this type of change.

I think Finkelstein wrote a great letter. Stop hating on the guy. I left when I seen him about to be elected but I think this letter is proper. Ya got guys sitting in jail with no hope. After the Florida SC destroyed the right to a speedy trial bc of stupid virus. At least he’s making an attempt to help.

This is unreal. We need to change the judiciary ASAP. Wtf is happening to these guys in jail? Y’all ever been in jail? This is wrong & the judiciary needs to fix it. Guy prob has a gd suspended license. Weak.

Good letter. This zoom technology really lends itself to some funny stuff being posted.

Funny to hear Lynch confront Weekes at a recent debate asking: “when you last try a case, gordon?”

Note to Tom ‘water sports” Lynch:
who are YOU to talk about other’s trial stats?? You haven’t tried a case since the 80s and YOU STILL HAVEN’T PUT YOUR NAME ON THE REGISTRY WHEEL TO ACCEPT INDIGENT CONFLICT CASES !!

Lynch at debates: “uh yeah, I’m going to take on cases too if elected.” (Really?! Then why haven’t you put your name on list to take indigent cases?)

Here’s the deal. Us Broward guys are harassed by the judges every time. “Can you help me????” Scary bc I gotta donate to sitting judges or else I get a cold shoulder. Anyone else get these calls? This is anonymous & I’m not naming anyone. Pay to play is the problem we have as lawyers. If you have any ethics. I think almost every lawyer in Broward is weak. I’m weak as well by not naming myself.

Gordon don’t be ashamed because they aren’t black…acknowledge and celebrate your wife and mother in law. Stop being ashamed and hiding them, it’s disrespectful.

Hiding your wife because she’s not black is not being very honest for someone seeking to run a public office. I think Finkelstein made a big mistake running Weekes as his successor.

Judges in Broward County Accused of Engaging in Courtroom Drinking Game

FORT LAUDERDALE, Fla.—Police officer Frankie Nunez entered the Fort Lauderdale courtroom Wednesday and threw up his arms in frustration, finding the floor littered with Solo cups, salsa, and Coors Light empties.

Had a good laugh when a lawyer cited the NY Post regarding the virus rates in Sweden. Not the CDC. Not an infectious disease study. Nope- the NY Post was quoted. What’s next the Enquirer? Do better research please. Perhaps then you’ll learn something like:
Sweden’s fatality rate is higher than that of their its neighbors. As of Wednesday, the country had over 20,000 coronavirus cases and over 2,400 deaths. In comparison, Norway has only 7,600 cases and 207 deaths. Deaths in Finland (206) and Denmark (443).
Also, other factors to consider about the spread of the virus is that these are less densely populated Countries and that Sweden does have some social distancing in areas hardiest hit.
Maybe do a bit of investigating before you quote a gossip paper. You’ll look a bit more intelligent.
