As the probation office in Broward is presently staffed and structured it is completely impossible for a minority person to successfully complete probation. Just ask the main supervisor (a minority member) Eric Simpson how it works.

But he didn’t get him off it. It’s suspended. He shouldn’t have gotten 60 to begin with. Etcetera. If he violates over 15 years he’s going for 60. Omg.

Truth is the petition and press coverage it generated got him out of it. End of story. I agree it never should have gone down in first place.

Attorney should have filed a motion to suppress the evidence. I would think Defendant was out of the car when it was search by police and the would be no evidence in the car relating to a DWLS that would need to be preserved, so Arizona v. Gant says you need a warrant to search the car incident to arrest.

Destry’s sentence was a downward departure without valid reasons. Will the State Attorney’s Office appeal? They have 15 days. The SAO is in Def Con 5 political mode. An appeal, which has merit, is probably not forthcoming. Black votes matter to Mike. I heard Mike was selling expungements for votes at the Urban League.
When this kid violates, and he will, the 60 year suspended sentence is meaningless. The kid will be back to square one and the bottom of the guidelines up to 60 years.
What will Destry do if he violates? Will Destry still be there if and when he violates? STAY TUNED

VFOSC statute is a joke. SAO and Judges making it up as they go along. Granted the smarter Judges apply it consistently and rationally within their own divisions but otherwise its a big fat joke of a statute. How is this young man not a danger if he has a 60 year suspended sentence? Odd it is. The Supreme Court needs to clarify or the Legislature needs to go back to the drawing board.

Completely agree. But most everyone in this County voted for “Chain Gang” Charlie Crist and the VOSC statute was truly his baby. Sun-Sentinel and HF strongly supported him too. And, my guess is whoever on that famous petition has the right to vote voted for him too. So, they should be fine with all this.

Destry doesn’t get it. the funny thing is criminal is his forte.
like contini, not what it takes to be a neutral and detached magistrate.

The kid got a lucky break, a second chance to be a productive, law abiding citizen. If he screws up again he deserves to serve his time. Most of us live our entire lives without ever being arrested.
