      Destry deserves his fate at the hands of Broward voters as evidenced by his history of abuse of attorneys and defendants as well as the information contained in this newest revelation in re the JQC complaint. He has shown himself to be unfit for office time and time again. Broward judges are a really bad bad bunch but Destry’s actions warrant investigation by the Bar with the appropriate discipline imposed. This guy is a disaster waiting to happen. He should be disbarred permanently in my opinion.

    Ratonya Dumas, a close friend of Herb Smith who started the viral petition, says Thrower contacted her on Facebook and tried to convince her to support Destry. Dumas also says that after he pronounced the more lenient sentence, Destry spoke at Smith’s Pompano Beach church.

    He should have fallen gracefully on the sword and resigned. He could have started his new life without the hounds on his back. Instead he gets a public probable cause finding and will now duke it out for all the world to see. I bet its because he wanted to keep his paycheck coming until the end of the term. I bet its the most money he’s ever earned in law. I bet he got a big raise when he became a Judge. I think there are many individuals on the bench that couldn’t make a judicial salary as lawyers.       It certainly appears that Destry was oiling the palms of these black so called community leaders as well as the political activist that has since landed in trouble of his own. All for the sake of garnering support for his campaign to be reelected. The allegations of his non-disclosure to either defense counsel or the state represent a flagrant violation of the canons of ethics but is not wholly surprising given the past behavior of Broward judges and the bag of tricks they have relied upon to get reelected
      As far as I am concerned, when the J QC is finished investigating this incident and taking testimony, former judge Destry will have to face up to the facts and face the following bar investigation that should ensue.
      It’s time that Broward judges realize that when they don’t play by the rules, they are going to have to face the consequences of their actions.
      DESTRY has been a rotten potato since he took office and the stench of his political gamesmanship have caught up to him.
      I can’t feel very sorry for him as in my opinion he symbolizes everything that is equally as rotten within the Broward judiciary.
      The JQC and the BAR should make an example of this duffis. He had no business sitting on the bench at all, the voters felt the same way, and now the sleazy Political Machinations of his questionable behavior are beginning to leak out.
      Equally disappointing is the way the Sun Sentinel has barely touched upon this issue.

        Destry has been a boon to challengers for running against sitting Broward judges. He’s exposed the soft underbelly of just how vulnerable these Broward jokers are.

    This matter, if fully litigated, now public, may be a real eye opener.

    If it goes quietly into the night, I might venture the power structure thought better of proceeding.

    After the Watson debacle, DB may seem the better choice, but given that the reputation of the elected judiciary may possibly be tarnished, it may be prudent to employ a more no holds barred strategy. Power respects power.

Often times bum lawyers that couldn’t make a nickel outside of a government office get appointed because they’re political greasers and then they transform into self righteous know it alls. The sad part is they never had any connection to the community that they think they have a mandate to represent. The ones that never stood for contested election are the worst.     The Federal authorities need to come to Broward. The message is not getting through to the Broward judiciary. The Broward judiciary continues to undermine confidence in the entire Florida justice system. Chief Judge Weinstein has demonstrated he’s incapable of leading the 17th Circuit to a better place. Justice Labarga, please invite a Federal investigation into the Broward judiciary to stop the corruption, dishonesty, substance abuse, and dereliction of duty that has plagued Broward judicial circles for decades.

    The common concensus about you was always “we’re friends off the bench. I just can’t explain his behavior on the bench.” or “he’s cool off the bench, he’s a dick on the bench. I just don’t get it.” Everyone you thought you were friends with had this to say about you. No one could explain or excuse your horrible antics. Being the most reversed judge on the bench didn’t even wake you up. The 4th was sending you a clear message and you continued to make bad rulings. It was as if you had no self awareness. You thought you were untouchable. Who would dare challenge you, right? Although I can’t stand Greenwald and although he didn’t do very well in the polls, I will give credit where it’s due–he single handedly opened the floodgates of what would ultimately be your undoing. And while it was happening, you still didn’t see it. Your friends all think the right thing happened here. Hopefully this will create some pause for reflection for you. It probably won’t, but here’s hoping.
    And a note to other judges reading this (with the exception of a handful)–none of you are untouchable. You may have 4 years left, but everybody is watching. Your division attorneys are taking notes on your horrible rulings so that when the time is right, the transcripts can be pulled. Stop being jerks and just do the right thing.

    A PD in usan told me once that she argued a motion to suppress that would have been dispositive. The offer was 15yrs. After the motion, usan called both sides side bar, and asked the state if there was anything they wanted to do before his ruling. The state didn’t catch his drift. He repeated himself “is there anything you want to do before I enter my ruling? Because once I do, SOMEONE won’t be happy and there won’t be anything you can do about it. Maybe you want to make an offer he can’t refuse.”
    Before usan rules, the state “gets it” and goes from 15 yrs to time served. The pd was under an obligation to relay the offer. Her client, who was in custody, took it. After the docket was through, and the record was off, usan signaled the PD side bar. He said “just so you know, I was going to grant your motion.”

    Usan is just an example of a Destry who knows how to not get in trouble. And how to make sure he doesnt ever make a ruling so that no one appeals and he can’t be reversed. He is, however, just as dangerous, if not more so.

The chief judge will be assigned a division and all three of those losers will have to do something that they haven’t done in years…..ACTUALLY WORK. His JA will actually have to come to work EVERYDAY instead of one day a month. How sweet it is.

        you are full of shit my friend. Mike worked his ass off for years prior to becoming a judge, and was a damn good criminal defense attorney and certainly paid his dues. Her honor has provided our community service more that has impacted Broward County more than you will ever know. She was compassionate, fair and controlled her courtroom. Maybe some didn’t like that, but ultimately she deserves our respect and as certainly motivated others to do more for our community. Perhaps you are just not making enough as a private attorney and should consider another field if you think that they have been milking the system.

    Usan’ order on the Peraza case reads like it was written by Schwartzreich. I’d bet anyone lunch he gets reversed on this one.

          doubtful. truth is, no one is going to run against usan – or haimes or rothschild or robinson. trying to defeat an incumbent is rough. destry was the exception, not the rule. in 2010, incumbents went 15-0. in 2014 only feren lost and nobody liked him. mccrazy has won twice, rosenthal got reelected while her dui was all over the news, watson also.
          usan, haimes are smart, they dont make stupid comments on the record and they dont act rude and arrogant. most of the established defense bar (ie: not the pds) like them. no one wants to take on robinson and d. bailey is not up until 20. none of the present incumbents are universally disliked like destry was.
          there will be at least 4 open circuit seats and 6 scott appointees up for the first time in 2018 – this is where the judicial wannabees will run.

          anyone who knows how the game is played understands this, all the rest of the talk here is nonsense

            Doubt that’s going to be the case. It’s a crapshoot for any judge in Broward now and not just the low hanging fruit like Destry.
            Judges in Broward haven’t faced up to what’s taking place yet and fail to see what’s coming down the pike, just like Destry.
            Bet Usan and several others will bear the burden of facing challengers when their terms are up.
            I don’t see the free ride Broward judges have enjoyed for years remaining the norm.
            Recent developments have proven this view to be a correct one.
            I dare say the judicial free for all is going to impact Usan and several more judges in the near future more than they know with several falling by the wayside.
            Rothchild, Robinson and Usan are most probably in for a big surprise.

                Usan isn’t the only Broward judge on the radar screen of potential challengers. With a name like his he may find himself wondering what happened just like Destry has as he picks up the pieces of the mess he created.
                All these duffises should be run against. It’s time they realized the gig is up and it’s off to the races if they want to hold on to what they feel is their God given right to milk the public trough in perpetuity.

                  Becareful what you wish for, you could be replacing a good judge with an elected disaster like Bailey or Levy Cohen.

                    Before considering Zaccor’s loss as the start of all incumbent Judges being vulnerable, lets review

                    1) Zaccor was advised many times after his appointment, as a Rick Scott appointee, he needed to get out into the community and establish a relationship with the leaders and residents of Broward County. While preluded from campaigning, a Judge is not precluded from establishing relationships in the community
                    2) Di Pietro vs Rick Scott: This lawsuit filed a few weeks before qualifying raised many questions about the appointment process which resulted in Nina being appointed, despite her weak qualifications and having nothing else other than being married to a then power broker.

                    This lawsuit put a negative spotlight on all Scott appointed Judges, resulting in Zaccor, Nina and Evans getting opponents. Without this lawsuit, it is highly doubtful, that any of them get opposed. Irony is, Di Pietro could have filed the lawsuit a few weeks after qualifying and it could have saved the Judges Evans, Zaccor and even his wife from getting an opponent.

                    3) David Dipetro and Trump. Why?
                    Zaccor comingled his campaign with Nina. Same campaign people, same vendors etc. Zaccor and Nina were inseparable every night on the campaign trail. Most of the Dems in town associated Nina with Trump and by their close association, Nina/Trump issues spilled over onto Zaccor
                    4) Many of the community leaders who would typically put even the worse incumbent Judge, Feren/Rosenthal for example, on a palm card refused to do so for Zaccor due to being seen as close to Di Pietro/Trump.
                    5) Zaccor also refused to accept support from some community leaders and/or publicize certain endorsements if Nina did not receive them as well.
                    6) Zaccor does not make a good first impression. If you meet a him a few times, he comes off as a nice guy. The impression of those who only met Zaccor once was that he was arrogant, aloof and a know it all. Because he did not take time prior to having an opponent to meet people in the community, most were only left with meeting him once.
                    7) Zaccor was out worked. Early voting and Election Day, Zaccor rarely left Nina’s side in Pines. He rarely went to other locations to meet voters unless Nina did as well. McCarthy, she was all over the place. It didn’t hurt that she was attractive and had a charismatic personality.
                    8) Cant deny, he had an awful ballot name.

                    So for those who are moping around the Courthouse bad mouthing the new Judge McCarthy because she ran against Zaccor “despite doing nothing wrong”, read and reread the above.

                    Zaccor did so something wrong and others on the bench need to see it. The days of hiding in the Courthouse and hoping you don’t get an opponent are long gone. Judges have to put equal time interacting with community leaders and engaging with its citizens to prepare for that moment if you have to run in the future.

    If the JQC , or where it will probably end up, The Florida Bar,
    finds Destry exchanged favors for ruling, i.e. taking a bribe,
    then the sheriff should arrest the activists who solicited that bribe.
    Last time we checked it’s a crime to even ATTEMPT to bribe a judge, let alone succeed at it.
    The JQC should not give immunity to these activists.
    Destry is gone and not likely to make a comeback so problem with him solved.

    They know who they are, Mike Ahearn, Lee Cohn/Bill Lewis, Dan Lewis and Judy Stern. 2018 will be a rough year for incumbents.     According to Ms. Maura Canter Staff Council for the FL Bar, Rule 4-1.6 / protections of communications between a lawyer and their prospective client, is no longer confidential. Confidentiality between a Florida Bar lawyer, and their client has been effectively suspended until further notice.

    The FL Bar apologizes for any inconvenience that the wide spread miscommunications may have caused the UN-knowing public.
