Scherer sentenced Cruz on 11/2. Did she say ‘see you next year’ to everybody as she left that afternoon?

Welcome to Broward where judges don’t work worth squat and its just a ceremonial position that requires two days a week.

Yes because all you Broward lawyers announce ready and don’t have your cases reached? More like when you are called to trial, you post about (1) how can the judge do a trial when there is COVID (2) how can the judge deny my 20th continuance (3) how can the judge try the case when I didn’t open my file yet (4) how can the judge try my four year old case when I have my client on a $20 per week payment plan for ten years (5) how can the judge try my homicide case when my trial partner is unavailable since Broward ASAs can’t try cases alone?

After Judge Fein at 99 a Senior Judge, Speiser, has 91 days in trial.
A Senior Judge is more productive than everyone but Judge Fein? In all of Broward?

JFC – Remember the days back in the late 90s-early 2000s when APDs were given awards for the most trials in a year and they’d have 10+ in a bad year. Those numbers would be higher than most judges on the criminal bench now. Pretty pathetic.

Zero accountability. Chief could make sure they’re each in court after 11:00 AM. But that’s going to cost votes. And no Chief job means no portraits.

The PD awards all disappeared when Cathy and Howie took down all the plaques from the wall because it reminded them of a day when working hard with good results took away from the attention being focused solely on them. Then it was all about kissing their lazy butts and informing on anyone that criticized them for ruining the office. As a reminder: Neither Howie or Cathy ever took cases the entire time Howard was PD.
That however never stopped either one of them from lambasting better and more experienced lawyers within the office. It wasn’t too long before all the experienced lawyers left the office rather than put up with the poor way the office was being administered. The truth remains the truth no matter how hard Howard tried to control the narrative.

STATE OF THE 17TH JUDICIAL CIRCUIT MESSAGE

While pointing out there are so few trials happening definitely highlights that the majority of judges are working only part time, it also will now prompt the egomaniacs among them to deny continuances so they can brag about their trial count. So let’s shhhhh.

Be honest. Judges mostly don’t like working afternoons. Lawyers on both sides hate trial stress (which is why lots of people become Judges, to avoid trial liabilities). It’s a perfect storm of inertia.
Fixing it is easy. There needs to be judicial oversight. Judges need supervision. They need to be given trials if theirs wash out. There also should be sentencing ranges agreed to before trial. Like S Kappy did on pleas. That takes out most of the terrible stress for the lawyers on the little cases. The cases that make up the bulk of the dockets. Like it was before the 85% / no parole days. This way trials will tick back up to where they’re supposed to be in an adversarial system. And the Murph’s and Feins of the world can still do the heavy lifting with the big dog cases and lawyers that go on for longer periods.

Sentencing caps may encourage perjury. How would that be addressed?

Thats why it’s smart these days to be a judge. Short hours, very decent salary for those short hours, full benefits, nice pension very reasonable health insurance coverage for life, plus not having to worry about dead beat clients paying you. How many lawyers have had to sell everything they worked all their lives for and still can’t afford to retire?

Most lawyers I know are doing very well. There are some struggling; they aren’t good at business. But they are true Americans. They pour guts and passion into the work. They make it or break it on courage. They’d rather die than live off charity. Importantly, they’d never rip off their countryman if they were fortunate to become Judges by putting in “short hours” like a worm. They believe in themselves and in keeping America great.

Most of them put in the long hours. At the courthouse. At home. They’re available. They aren’t riding horses.
