      Does Howard think Mexicans are stupid? Howie sent an e-mail addressed to a few of his family members and, I think by mistake, to everyone at the PDs. It was about an article about the “worlds ugliest dog contest.” Nothing even remotely interesting to PDs. Last year’s contest was taken by a hairless Chihuahua. The title of his post is most troubling: “Not a stupid Mexican hairless this year.” While the hairless Chihuahua was ugly, I don’t think it was necessarily stupid, unless, well, you think Mexican’s are stupid.

    Attorney Given Probation, Fine For Drug Charges

    Howard Finkelstein, a Fort Lauderdale lawyer known for his trial tactics and his ponytail, on Wednesday was spared a felony conviction that could have cost him his career.

    He was sentenced by Broward Circuit Judge Patti Englander Henning to five years` probation, a $2,000 fine and 150 hours of community service for drug possession and driving under the influence charges.

    Henning agreed not to formally convict Finkelstein on the three felony drug possession charges, enabling Finkelstein to keep his right to vote and a clean record. It also could help him avoid disbarment by the Florida Bar, a possible consequence in such a case.

    “It`s going to help us,“ said Harry Gulkin, Finkelstein`s attorney. “He can truthfully say he has never been convicted of a felony.“

    Finkelstein hugged Gulkin, and Finkelstein`s wife, Donna Chase, wept when Henning announced her decision.

    Henning read about 75 letters in support of Finkelstein and listened to several judges and lawyers praise Finkelstein`s legal ability before she decided to withhold the conviction. An additional 15 lawyers and friends appeared in the courtroom but did not speak.

    “I don`t think you should be given any special treatment,“ Henning said. “. . . On the strong majority of first-time offenders, I would withhold (conviction). I would be in error to do anything less.“

    Finkelstein, who said his drug and alcohol addiction was killing him, said that his five-year probation is a long time. But, he said, “It beats the hell out of death.“

    He said he plans to begin working with the Broward Public Defender`s Office in January as an investigator.

    Assistant State Attorney Jeff Marcus had asked Henning to convict Finkelstein because on July 1 he obtained a court order that allowed him to retrieve drugs confiscated from a client. Finkelstein then kept the drugs, he said.

    “This is not a typical case,“ Marcus said. “He used his position as an atttorney.“

    Finkelstein, 34, was arrested on July 2 when his 1984 Cadillac veered off the road and struck a Broward Sheriff`s Office patrol car parked on the grass in the 2000 block of Northwest 56th Avenue. Drugs were found in his car.

    In August, he admitted to charges of possessing cocaine and other prescription drugs and driving under the influence.

    Gulkin said the Bar will automatically suspend Finkelstein for three years because of the felony charges. But Gulkin said he will petition the Florida Supreme Court to reduce the suspension.

    Several judges spoke in Finkelstein`s behalf during the sentencing hearing. Gulkin said he hopes their comments will show that Finkelstein`s addiction did not affect how he represented clients — a major concern of the bar.

    Former Broward County Court Judge Lawrence Roberts, who has battled an addiction to alcohol which forced him to resign from the bench in 1981, described himself as a “living example“ of rehabilitation. Roberts said the Bar allowed him to return to his law practice.

    “It would be a real tragedy if Howard Finkelstein were not given that opportunity,“ Roberts said.

    Henning convicted Finkelstein of the driving under the influence charge, a misdemeanor, and placed him on a six months` probation, imposed a $500 fine, ordered him to serve 50 hours of community service and restricted his driving to work and to counseling sessions.

    On the three felony charges, Henning put Finkelstein on five years` probation that requires him to attend drug counseling and submit to random drug testing, to pay $1,500 and to serve 100 hours of community service not related to law.

    FORT LAUDERDALE, Fla. – Last week Local 10 News reported on a serious problem at the Broward County courthouse — some of the poorest offenders, many of them homeless, are not getting legal representation in court. It’s what some claim is an ongoing violation of the Constitution, but now things are changing in the right direction.

    William Mosher, 52, is homeless and apparently mentally disabled.

    Since 2005, Mosher has been charged more than 80 times with municipal violations like trespassing and open container, but this past week he finally has someone in the courtroom to help him.

    “I’m going to appoint Mr. (Steven) Schaet to represent you,” Judge John Hurley said.

    Mosher and other municipal violation offenders got an attorney to represent them at first appearance just like everyone else gets.

    “For the first time in six years there’s actually a defense lawyer (who is) going to court for the homeless,” Broward County public defender Howard Finkelstein said.

    Finkelstein has complained for years that the city of Fort Lauderdale has violated the Constitution by not providing an attorney in first appearance court. Now, Chief Judge Peter Weinstein said the city needs to do just that.

    “The only reason that’s happening, quite frankly, is because of you, Bob,” Finkelstein told Local 10 News investigative reporter Bob Norman. “If you hadn’t done these stories, this would have gone on.”

    He had harsh words for Fort Lauderdale Mayor Jack Seiler, who maintains counsel isn’t required at first appearance for those offenders.

    “The mayor is well aware of what is going on here and everybody, due to political expedience, looked the other way,” Finkelstein said.

    Seiler defends his stance but said he now wants the city to contract with the Finkelstein’s office so there will always be an attorney for those defendants in the courtroom.

    But Finkelstein said the city will have to provide its own attorney.

    “I only contract with people I trust,” Finkelstein said. “I don’t trust the city of Fort Lauderdale when it comes to homeless.”

    So what if the city goes back to its old ways and stops supplying an attorney to the courtroom? The chief judge said he’s working on an order to give Hurley express consent to throw those cases right out of court.

I am supporting Gordon Weekes because I think he is a true defense attorney who cares about the criminal justice system. I am going to be asking Mike Satz to make some major changes and will make a final decision about 2020 after the conclusion of those efforts. This is what the defense bar is supposed to do. Ask for change and when you don’t get it run.

          The problem you created for yourself is this, maybe the threat of you running again could get Satz to make some changes (highly doubtful), but it doesn’t matter. Why? You do not see you are the victim of your own almost success. You coming so close, has opened s door to others running, despite whether you run or not. The majority of voters do not care about the internal running of the SAO. What you did last year was show other potential candidates who have the money and ability to run a successful campaign to run. You will end up last on the ballot with 3 or 4 other candidates, at least one other a woman. In the end, there will be a new SA in 2020, most likely it will not be you.

          Enjoy your almost success for another 3.5 years and accept thereafter you will nothing more than a footnote.

    When the sun goes down Jan. 7, 2019, Florida’s governor will be Rick Scott, and Barbara Pariente, Peggy Quince and R. Fred Lewis will almost certainly be justices on the state Supreme Court.

    When the sun comes up Jan. 9, all four will be out of office. Scott, who is term-limited, will have handed off his duties to Florida’s next governor — whoever that may be. The three justices’ terms will be over as well, and all three are past the mandatory retirement age.

    But what happens on Jan. 8? Scott says he intends to fill those three vacancies on his way out the door. A coalition of citizen groups headed by Florida’s League of Women Voters says he doesn’t have that authority — a position seemingly validated by voters, who rejected a constitutional amendment three years ago that would have clearly put the decision in Scott’s hands.

      My recommendation to Governor Scott is to appoint a dedicated jurist like Judge Robert Diaz to the Supreme Court. Judge Diaz and others like him have served honorably for decades and have a track record of stability and sound rulings that will benefit the highest court. Appointment to the highest court should be made based on experience (not politics) and there are many unsung heroes of the Florida judiciary who can bring experience to the Supreme Court. Judge Diaz has additionally to his honorable service dedicated himself to teaching and mentoring students who become lawyers and judges themselves. This is my thought and others too in agreement for Governor Scott.

    Does Howard think Mexicans are stupid? Howie sent an e-mail addressed to a few of his family members and, I think by mistake, to everyone at the PDs. It was about an article about the “worlds ugliest dog contest.” Nothing even remotely interesting to PDs. Last year’s contest was taken by a hairless Chihuahua. The title of his post is most troubling: “Not a stupid Mexican hairless this year.” While the hairless Chihuahua was ugly, I don’t think it was necessarily stupid, unless, well, you think Mexican’s are stupid.
