POSTPONED!

The County Commission looked poised to vote down Mark Bogen’s proposal to name the Ceremonial Courtroom after Jack Tuter, when Tim Ryan kept the item alive by asking for a postponement for Tuter to seek a JEAC opinion as to whether the proposed honor for a sitting judge would run afoul of judicial canons.

Steve Geller took the initiative to remove the item off the Consent Agenda. If it had stayed on Consent, it was a done deal. Geller, however, wanted discussion, and was soon joined by Dale Holness, Mike Udine, and Nan Rich in voicing strong concerns against the precedent of naming something for a relatively young and healthy person.

Geller, referencing Alcee Hastings and others who have received honors while living, stated:

We have made exceptions when people appear to be close to dyingperhaps if he were retiring …

And from Dale Holness:

The entire community knew (Hastings’) health condition …

In response to Mark Bogen’s spurious argument that precedent had also been set via the County Commission dedication plaques that adorn most large public building projects, Nan Rich stated:

The plaque that goes up on a building is not the same … I just have a problem naming parts of buildings for people who are living …

In any event, the whole thing is now set off until the next County Commission meeting in August, pending the aforementioned JEAC opinion. Ryan and the county attorney discussed the possibilities of motions to disqualify Tuter and other legal issues if the naming goes through, echoing concerns we’ve heard regarding Tuter presiding over cases involving Broward County.

Will Tuter seek the opinion, or, recognizing today’s political winds, potential ethical quagmires, and the thoughts raised in Sounds About White and elsewhere, does he withdraw his name from consideration? Does he seek the opinion, and the JEAC puts the issue to bed? Does it still pass, despite today’s on-the-record strong concerns of four commissioners? Does it go down in flames on a vote in August, or does it quietly die on the vine in face-saving fashion before the next meeting, without coming up for a vote?

      It was an absurd idea that was dead on arrival. Sort of like the job Tuter has done as Chief Judge of a circuit in turmoil which he has continually contributed to.

      Just when you think Broward’s Judiciary can’t sink any lower, Tuter shows there’s no bottom to the shameful behavior of even our chief judge who has throughly embarrassed himself by yet again demonstrating the character weakness and ill advised actions of a circus clown on parade.
      Its time a real leader take the helm.

    Dude…WHAT has tuter done to deserve the building naming?? Serious question. He’s basically the manager of the judges. What has he done? In the community? For the people? He manages judges. That’s it. Charlie the homeless guy has done more community outreach by yelling at anyone who walks by him. Tell bogen to name the building after Charlie.

    I would be disappointed to learn if Judge Tuter had been part of this plan. To take credit for the work of his predecessor Judges like Judge Weinstein and Judge Tobin in making things happen for a courthouse would be a selfish act extroardinare.

      Iv’e called Mr. Bogen’s office and voiced my displeasure at the idea of naming anything after Broward Judge Tuter.
      It is my belief that Judge Tuter has done nothing to deserve having a courtroom named after him. The idea is utterly ridiculous.

    City Commission Approves Rubin Stacy Memorial Boulevard as Secondary Name for Segment of Davie Boulevard

    The City Commission adopted a resolution approving Rubin Stacy Memorial Boulevard as a secondary name for Davie Boulevard between I-95 and US-441. In 1935, Mr. Stacy, a black man who was about 29 years old, was lynched in Fort Lauderdale without the opportunity to have legal counsel or a trial after being accused of threatening the life of a white woman. The City of Fort Lauderdale seeks to memorialize this injustice and bring awareness to the negative impacts of systemic racism on our society. City staff and Broward County staff have developed a signage plan that includes modifying or replacing approximately 60 signs. The estimated timeline for installation is 12-16 weeks.
