PRYOR FOR REOPENING

Bill Barner, president of BACDL, sent the following email earlier this morning to the BACDL list serve:

Good morning. Yesterday I spoke with our incoming state attorney, Mr. Pryor. He is interested in beginning in-person hearings on a limited basis. He wants to know if our attorneys would want to begin non-jury evidentiary hearings such as stand-your-ground, VOPs, and Motion to Suppress. The idea would be to space out hearings so that there are limited people in any one courtroom at a time and to wear masks and practice social distancing.

We would need the chief judge and the clerk to agree. But Mr. Pryor wants to measure our interest in the meantime.

Please respond to me as soon as possible with your thoughts.

This would mark the first notice since March when a litigation stakeholder, incoming or otherwise, despite only two Zoom links for in-custody hearings more than nine months into the pandemic, has publicly expressed willingness to reopen the courthouse …

      Bad for morale. Sends a message others aren’t capable. Sends a message that promotions to top positions will still be bottlenecked–bad for retention. Bad optics as a supposed agent of change. Bad optics for trying to establish independence and garner respect as a leader when 33 years old. There’s no benefit. A new direction?

    So courts think that they should remain closed until Covid mysteriously disappears?….
    If it hasn’t disappeared for majority of the year. It doesn’t even make sense. Everybody walks into a supermarket with unsanitized hands…. touches the products and then we bring it into our vehicles… then we bring into our homes…. and then we eat the damn virus.
    We all have been exposed to the virus whether we want to believe it or not.

    To live in fear…. we already stopped living.

    At this point it’s not going to get worse . More of us are immune and don’t even know it. I’m sure majority has developed antibodies to fight off this virus.

    You cant have your cake and eat it too.

    You dont want the virus…. You dont want Due Process…. Do you want to prosecute?

    You have Executive Orders tolling speedy and Statutes of Limitations. You have the presumed innocent sitting in jail with no hearings. Majority of them are indigent and have public pretenders.         Exactly. We can all assume everyone eats from the supermarkets or restaurants. Majority of the people that work in those industries are young people that come from low income households. If you pay attention alot of these young people are not scared of Covid.
        The products come from warehouses where low income people work. They get on to the trucks, and are shipped to the stores, and stocked on the shelves. People are not even wearing masks properly. Some people even remove their mask to talk (so you can hear them).
        The most essential thing we can agree with is food. At this point everyone is running from a virus. It’s almost a year we been weakening our immune systems by sanitizing everything,wearing masks, reducing our exposure to common bacteria. So now if we do get Covid our body will have a harder time fighting it then we originally would’ve had when our immune systems were much stronger.
        More people were dying from the misuse of the ventilators. Most people that were already dying had more exposure to Covid from being in the hospital frequently due to unrelated health issues. So now when they die from their unrelated health issue. They blame it on Covid because it was in their system. Marijuana sits in your system for approximately 30 days. If a marijuana smoker dies. You can say he died with marijuana in his system ; even if that was not the cause of death. I gave up on the Covid hype in August. I have started living my life normal again and have not contracted the virus.
        What if the virus does not disappear until 2022? Crimes are still being committed. So many open cases will overwhelm the State Attorney’s Office. Also the defense and the judges. They will start forcing plea bargains without knowing the facts of the case and no due process. If alot of the defendants were smart. They would figure out how to play their cards right. Broward needs to sit at a table and come up with a sensible plan. The vaccine cannot just be made without testing it on real people. They have to check for reactions, side effects,etc. This takes time. Are we waiting for herd immunity? What is the plan? The virus is not going to disappear so we need a better plan.

      Actually no not we all maybe YOU walk into the supermarket with unsanitized hands and dont wipe it down prior to bringing it in your home or car but I do. All veggies and fruits get put into waymter with vinegar and everything is disinfected prior to entering eating or placing in home and u should do the same.

    Minorities die at a much higher rate from Covid-19 due to lack of access to quality health care. Opening the courthouse back up for hearings would have a more devastating impact on minorities. Do black lives only matter when someone is running for office?

    People die everyday. Covid is an excuse to kill minorities… Minorities are dying more yet they are less afraid. They are the most fearless. They ignore the symptoms and continue to go to work.They work the most essential bottomline jobs and are exposed to it more than other races. Going to court wont change that. Go to the warehouses, supermarkets, and restaurants, use delivery services, ride share apps, public transportation, etc… you will see minorities are exposed the most to the virus… race doesn’t increase your chances…. exposure does. By your theory close down the warehouses, supermarkets, public transportation , etc…. going to court doesn’t stop anything. Court shall be open specifically for trials. Their are procedures and protocols that can be put in place to reduce the spread. Everywhere else is open. The court house is terrified due to poor leadership.

      Worse than any Chief in history. His plan is to do remote jury trials. He has no plan. He’s reactive. There’s no access to courts. His Judges are losing at the polls. Powerful political forces are working now for a repeat in August. This man is not capable of handling the mess upon reopening. The Judges are sheeple. None of them will step in. It’s terrible.

    Someone obviously does not understand the major mechanism for the spread of Covid-19. It is mostly an airborne disease spread from close contact with others who are exhaling the virus. Wearing masks and social distancing are good, but not a guarantee for the avoidance of infection. We are now facing the possibility of the peak of the transmission of the virus due to the holiday season. We all want to get back to work, but rushing back into the courtroom any time soon is just plain dangerous. Follow the science and by the middle of next year we will likely be safe again.

      Judges are not essential workers. Lawyers, Clerks, Court Reporters, Courtroom Staff are. Any 5 year lawyer with a wealthy connected family can be a Judge. Let them stay home and Zoom it in. Productive members of society that add value to the greater good can get vaccinated first and go to work. Lazy Judges aren’t needed anyhoo.
