PUT ON A HAPPY FACE!

Yesterday’s two hour JQC remedial judicial training went off without a hitch.

The meeting was mandatory for all Broward judges, and we’re told attendance was taken.

JQC staff addressed all Broward judges to gently remind them of the p’s and q’s of the judicial canons.

It is unknown whether or not the JQC tour is stopping in other jurisdictions, but we’re guessing it’s a one-off given the recent landslide of JQC cases in the 17th Circuit, already the historical all-time JQC champ statewide.

Expect happy faces on the judges at least for the time being, and be sure to post a comment right here on JAABLOG if not …

    These mandatory events are always like preaching to the choir. No doubt Farmer didn’t attend. That should also be taken into consideration when the JQC evaluates any contrition. Wealthy or not, he ought to lose the pension he earned as a state legislator. The judicial job allows him to use his multiplier toward a much higher salary. The taxpayers shouldn’t have to support that moron who contributes to making even the decent Broward judges look bad.

        It’s not “a few bad apples” Broward judges have had a problem with behavior at a much higher rate than the rest of the state. Most are good, but there are enough bad ones to ruin it. I think it is good they are all regularly reminded to be professional.

    I think my judge was unaffected by that conference. No second thought, totally unaffected by it. What an fing joke of a zoom proceeding today. Where do the jas and these judges come from. What law do they know and why is JA dictating or misrepresenting matters.

    Some of you on here are really jaded.

    The overwhelming majority of the Broward judges are competent, professional and let lawyers conduct their trials. And most of them are pleasant people off the bench, who engage in extracurricular community events. And they are also family people who do their best for their families, and for Broward.

    But mistakes will be made by all human beings. You can’t expect anyone to be perfect, we are all human. As all of you who are reading this, and posting on here, are also human.

    4 people who have had a recent issue, out of a total 90, is not indicative of any overall problem with the majority of the group, or even any overall problem with a minority of the group.

    Some of you act as if any of these 4 were arrested for a crime of moral turpitude or violence.

    The judiciary has demonstrated time and again that it cannot be trusted:

    1) Most judges lack any ounce of impartiality or neutrality. For example, judges such as Coleman, Odom, Alspector, Fein, and Usan rubber stamp anything the prosecutor asks for. They ACTIVELY HELP the State. They even make arguments for the State.

    2) Most judges are flat out incompetent.

    3) Most judges are lazy. Them and their JAs refuse to work.

    It is unacceptable. Most litigants have no faith in the impartiality, competence, or integrity of the judiciary.

    Public reprimands don’t cut it. Removal from office by the JQC. That is the only remedy. Period.

    I had hearing regarding appellate costs. The judges order stated “ the plaintiff will withdraw the motion to tax the appellate costs and refile in the appellate case pursuant to the Florida Rule of Appellate Procedure 9.400.” The appellate court reversed and said “Pursuant to Florida Rule of Appellate Procedure 9.400(a) costs are taxed by the trial court and not the appellate court.”
    I filed a motion for rehearing with cited rule and case law in trial court and a different judge, unknown why, denied the rehearing.
    Do judges read the rules of procedure or case law provided. Or do they not care.
    I had to appeal one lousy ruling seek review of another lousy ruling. My confidence in a fair trial is about a 1 on scale of 1-10. To put at 1-5 would diminishing my expectations.
    If anyone knows who cites stuff without reading it let me know and the suite mate doesn’t read anything either.
    They get paid to read, listen to arguments and make INFORMED decisions. Not unilateral decisions

            Harry was a one time, one term Broward judge who slipped off the rails and worked for scratch the rest of his career if you can call it that. His wife was his secretary. He had no involvement in the film industry nor any other entertainment sector.

    Tuter could have reassigned the case to a judge other than now-former Judge Elizabeth Scherer, who was assigned the case randomly and had never presided over or tried a death penalty case.

    But he stuck with her.

    Asked if he should have made the switch, he said, “Either way you’re going to get criticized. If you give it to somebody who’s, for instance, had experience, but then you look at their record and see well, they had four death penalty cases and three of them were reversed.”

        JT and Whiney were probably the worst CJ’s in history given the constant JQC turmoil of the judiciary they ineptly were in charge of. If the County Commission had a shred of decency they’d strip both Tuter and Weinstein’s name off the courtroom walls. It’s an affront to anyone that knows the truth.     Always thought she was a spoof considering how she got to the bench thru a rigged JNC process after skating her way thru her tenure in the SA;s Office and then is assigned the Cruz case in a highly questionable way which still bears scrutiny rather than an experienced and knowledgeable judge.
    Tuter bears responsibility and some say was part of the farce.
    Now she and Tuter are reunited working for Scherer again. Any wonder why ? The co-conspiracy after its failure lands back in the nest if you ask me.

      He ran for Judge and came in 4th. It was the election with Perry Thurston that Michael Kaplan won in the end and some other person. Then he went to work for Scherer the king of the JNC. Then like a short time later he was appointed to the bench despite the strong message the voting people had sent a couple years before when he came in dead last. Then he latched on to whomever the Chief was after Damoorgian left and was in Admin until Weinstein got him elected successor Chief. This is all my recollection so Google it to make sure.

      Has anyone taken a recent look at the posts from Lawyer Sean Wydner and his continued lack of awareness regarding his “Fuck Israel” comment on Facebook? He keeps posting comments and is actually complaining he was called out while defending his Anti-Israel comments. He even made these comments while on vacation. What a dick.

      He posted “Fuck Israel” and that Israel should be stopped one way or another – on a Jewish person’s FB page – and is whining and complaining that M. Gottlieb responded to his comment ….which I thought was too kind actually. Wydner keeps digging himself into this Anti-Israel corner hole without even an apology as to maybe the choice of words. What kind of lawyer would do that?

      Of course, if it was not big deal, why did Wydner delete the post? What kind of judgment does he have when he makes these comments in Broward where he practices law, which has a large jewish population. Shame on him for being not thinking of his law partner before the posted comments.

      I love Brian Greenwald’s comment saying it was wrong to bully someone for expressing his views. Apparently it’s OK to post F Israel on a FB comment of a jewish dude, but don’t dare call him out on it when he does. Greenwald’s “but I am also jewish” claim ignores common sense…..Wydner poked the bear by intentionally posting an anti-israel comment on a jewish guy’s FB. Imagine if that was done in other circumstances……

      Regardless, that’s my two-cents, which will of course prompt other anti-israel comments on this blog I am sure.

      At least Sean Wydner let his true feelings be known…..for better or for worse.

              BACDL should have another category of award for anyone that runs against a sitting Judge. Whether they win or lose they make things happen that benefits all of the legal community. It takes a lot of gumption to do it and it should be recognized. Like Grennwald setting the balls in motion for Destry to lose. Like Jahra Mclauren for making Rosenthal lose her shite and getting booted. Or like Judge Bober who beat Dijols. BACDL needs to do more to encourage opposition for all the Judges to stop the baby screaming robe entitlement phenomenon that creeps in and makes a lot of Judges so terrible. They could name it the Al Pacino after the character he played in And Justice For All that was fighting so hard for real justice.

    Few people abused their power more than Barbara McCarthy. The sheer evil that she unleashed on those who appeared before her must never be forgotten.

    She didn’t just fail to follow the law. She openly spat on it. Her cruelty towards the defendants that appeared before her was unprecedented and unparalleled.

    She would deny hearing dates to those who were waiting in jail. She would openly help the prosecution. She would sadistically refuse plea deals. And her sentences reflected her cruelty and psychopathy.

    Few people ever wore the black robes who demonstrated a more despicable character.

    Separating children from their fathers is a problem we see too often in family court. Judges favoring mothers, restricting parental rights, and/or disregarding the law is a routine daily occurrence.

    She should be held legally accountable if she is not following the law, this is a JQC in the making!

    The judicial branch of government continues to demonstrate the following:

    1. It is NOT neutral. It favors police, prosecutors, and large corporations.

    2. It is by far the weakest branch. It is submissive to the executive branch, including governors, mayors, government agencies, and especially the police. It is afraid to strike down unconstitutional laws written by the legislature. It is afraid to enforce its orders against the other branches.

    3. The judiciary is lazy, incompetent, and utterly incapable of delivering due process.

    This may seem like an oxymoron but we must both “reel in” the judiciary while simultaneously “empowering” it.

    We must reel them in by creating a large and powerful civilian oversight board with the power to evaluate judges who behave unfairly, to evaluate and punish judges who display a lack of neutrality, and to remove judges who lack neutrality! The JQC is not enough. This board would be large and powerful enough to fine, suspend, and remove judges who abuse their power!

    Ironically, we must also empower the judiciary with its own sergeants at arms who can effectuate its orders against the executive and legislative branches. For example, if the police or a law enforcement agency ignore the orders of the court, there must be a force of strong men who will arrest them and bring them before the court. A police for the police.

    This is the only way.

      Well he’s been gone some time and the new Admin still hasn’t got paper towels in the courthouse tower bathrooms. So much for change. If I want to eat a melted chocolate bar or a ripe mango out of the husk on lunch break I still have to dry my face after washing up with toilet paper which gets stuck in my eyeliner and I look dumb in court. It’s not much to ask for paper towels.
