Imperato to resign? – a bailiff was caught scurrying away earlier this morning with what looks to be some of Cindy Imperato’s personal belongings in an archive box, including an FSU football.  When asked a few minutes later whether Imperato was indeed calling it quits, her JA said she was “undecided“.  We’ll be following up with the chief judge and Tallahassee shortly …

      Undecided. The writing is on the wall, 5 of 7 Supreme Court Justices have signed off on her order to show cause. If she isn’t realistic enough to spare herself the humiliation, she will be removed soon enough. Frankly, I’d rather see her go down in flames.

    The illusion that Imperato is a great judge belongs to the deluded. She was an extra prosecutor on the bench in criminal and in the pocket of the banks while doing penance in the foreclosure division, refusing to apply the law, allowing incompetent evidence, and having a social relationship during proceedings before her with the banks’ attorneys likely stemming from her husband’s association at his firm with the lenders. The measure of her perfidy is her belief that as a twice convicted DUI offender she could sit in judgment of those charged with her own crime. As for her ability to earn in private practice, that would be a first. She’s a career suckling at the teat of the government. A fine jurist indeed. She may be a wonderful person but she could not and cannot sit in judgment of others while having been convicted of a crime. Not even in Broward County could that be allowed.

    The problem with the SAO is too kanyvinidan Chiefs and not enough Indians. Anyone noticing the steep decrease in age of the prosecutors assigned to homicide isn’t hallucinating… There aren’t enough kids in their 30s willing to ride out the fact that Satz is paying guys coasting to retirement in case filing 3 times their salaries.

    If Satz were to implement a “you must try one case per year” policy… Particularly those whose salaries exceed 80K… Hilarity ensues. Please mike do this… All of us want to see DVs on your kitchen cabinet. When’s the last time Tony Loe tried a case?

    She’s lived her life working the system and then found fertile ground in Broward among the rest of the judicial misfits looking for a free ride. Now the system’s working her over.

    For her to have fought the battle to keep her job the way she has after having been found guilty by a jury, after trying to catch a break by flashing her badge to the police officer that pulled her over after receiving a phone call from another concerned motorist telling them she was swerving all over the road, after calling the police officer’s reputation into question durring her trial, after refusing to take a breath test, without a question shows this judge should have never been sitting in judgment of others.
    Imperato’s tenure as judge over the years has been punctuated by several newspaper articles calling attention to her exploits .

    Now if she has any respect for the Justice System that’s kept her employed or her fellow Broward judges or the citizens of Broward who have paid her tab, she should resign and let Broward get beyond this sordid episode be put to rest once and for all.
    She makes the Third Broward Judge to get caught in the act. This shows there’s a very real problem with alcohol and substance abuse on the bench in Broward County.

    At least the other two had some sense left and resigned. Imperato should resign too.

    Rumpole says: Good riddance.  This judge was a nasty, sarcastic, impatient jurist who pandered to police officers. We had a memorable motion to suppress in front of her, during which she spent the entire time chatting with her clerk, snickering and passing notes to the clerk, and rolling her eyes and playing to the other police officers who were in the courtroom for another case. Our client said “I can’t believe this is happening to me in a courtroom in the United States.” So, no great loss to the bench or the cause of justice. Karma.

    Someone asked what does Weinstein do all day? He sits around and waits for another judge to get popped so he can stick them in the foreclosure division. Because the best way of dealing with the foreclosure crisis is to let the worst circuit judges we have and some retired county judges with no jurisdiction rubber stamp defective foreclosure complaints.

    What is so hard about staying on the bench?

    The ground rules seem straightforward.

    1. Be fair and courteous.

    2. Be on time.

    3. Tell the truth and never lie.

    4. Don’t break the law.

    5. Seek help immediately if stress or the bottle are becoming hard to manage. Resign if substance abuse has taken over and long term treatment is in order.

    6. Immediately accept responsibility and cooperate fully if something bad / out of character occurs and never, ever attempt a cover up.

    Seemingly simple. The JNC and Bar should have to administer psychological tests before a lawyer is allowed to run or apply for Judge . Too many are getting through that can’t even follow kindergarten level rules.

    Too bad. Was looking forward to reading her feeble excuse to why she should remain judge. She’s always been a prosecutor on the bench so as far as being a fair arbitrator, it just wasn’t so. Might have been a fun person to hang out with, but should never have been a judge. Hope the rest of the judges have learned something from this.

      This sounds funny but brings a good point: Judges are not searched when they come to the courthouse. They can carry guns so there is no issue as was the thinking before the arrests. However it should now be mandatory to screen Judges to ensure they are not violating the ban on alcohol and other types of contraband by bringing such things in. It may be unthinkable to think they would violate the trust in them but once upon a recent time it was unthinkable that three Judges would be arrested for such serious crimes in the ultimate breach of trust. The time is now to search them for our benefit as well as their own. If battling alcoholism and sneaking alcohol or drugs into the courthouse all will benefit by catching it at the door before another embarrassing episode hits the news or an intebritaed armed Judge lets loose with a gun and hurts someone or themselves in the courthouse like that maniac who shot the clock.

    The sad part is she still could have gotten away with the refusal if she’d just mea culpaed the next day after sobering up. But the central character trait making her unfit to serve, arrogance, took over throughout the process right up to the gut busting laughable “remorse” in the 13th inning. Thank goodness a true courageous lawyer Mr. Catalano exposed her unchanged ways so the Supreme leaders of the judiciary finally stopped arguing and dumped a truly horrible Judge.

    I guess not even Imperato with all the obstinate nerve she’s shown until now could come up with another whopper worthy of changing the minds of the Supream Court in what was going to be their ultimate decision: that of removal from the bench in Broward.
    And rightfully so.
    If you have a judge that can’t or won’t follow the law, toss them off the bench and get another judge who will.
    She’s shown what she’s made of and its not needed anymore.

    Broward judges need to be shown the error in their thinking.
    With the rash of judges either removed or that have resigned of late, let’s just hope in the future we get some that don’t come from the rank and file of these government career hacks with bad entitlement problems.
    They seem to be the ones that create the stench that still permeates the Broward Bench with all their psychological baggage.
    Of course it would be a step in the right direction if we had a chief judge that showed the slightest inclination toward some leadership qualities.

    Imperato’s got some real rationalizing to do about now. Chances are it won’t have much to do with reality and more to do with blaming the nasties that held her responsible for her actions. This is one outcome she wasn’t counting on at least initially with the failure of politics to pull her out of the pit she walked into.

      Gardiner obviously was the worst. She still needs to be prosecuted for perjury so she loses her pension. There”s no statute of limitation on perjury in connection with a capital case.

    Imperato deserved to have to vacate the bench. Her behavior has demonstrated a woeful disrespect for the office she held. The way she handled herself has proven she would go to any lengths to hang onto her judgeship until she was required to answer the question we were all asking.
    I think the Supreme Court did the right thing unlike the Overtly Politicized JQC which has become more concerned about protecting judges than it is in protecting the public. The Bar suffers from this same problem.

    Imperato has outstayed her welcome despite what Weinstein has to say. The Supreme Court has spoken. Broward judges sound like sea lions barking into the wind and need to accept the inevitable.
    Broward judges are on the radar at long last and Imperato is just the latest of an ever growing long list of judges facing the change that will continue to deminish the ” gang mentality ” that has continued to be encouraged by past judicial administrations.

    Broward judges seem to have been put on notice. Let’s hope they bone up to the clear message: Judges that don’t tow the new line won’t be around long whether it’s by removal, resignation for those that can’t take the heat, or in the way of political challenge.
    Broward’s Judiciary has brought this all on themselves and are apparently very slow learners if the past plague of errant judges can be any gauge of their lack of progress.

    Judges are perhaps the worse among the bunch. Whether it’s the problems seen in the papers with the Broward Commission or the systemic abuse problems seen with a whole list of Broward judges, it’s a free for all as long as the citizens of the State of Florida are paying for it !
    It almost wants to make you barf when they talk about their public service while they rake in the big bucks and more than hefty pensions all the while babbling about how much they could be making in the private sector.
    Most couldn’t make it in the private sector. It’s a lot easier and more profitable to milk the public trough. Check it out on the State of Florida employee website for what these honkers are pulling in not even counting the double dippers who come back for more. You’ll be shocked. Broward is one of the worst.
    Say what you want about Governor Scott and the Republican controlled house. It’s a mess.
    Imperato’s so called service is a joke just like the rest of them. She can now retire on her fat pension for good although in disgrace. What does she care as long as the drinks are on the house?

    I think Labarga and his staff of justices would have allowed her to stay if she hadn’t done exactly the opposite of everything the Sheehan precedent states. I would expect observers, lawyers or otherwise, to understand this. The mocking is unnecessary, but the logic is doubly obvious in light of this being #2 and she still tried gamesmanship. It is necessary if Judges are to remain respected individuals for them to be removed when they behave this way, and whether they are defense or prosecution oriented is irrelevant.

    Have you ever heard of allowing a judge to hear cases while wearing a monitoring device ? That’s what’s been allowed in Broward County. Judge Imperato should have resigned after having been found guilty by the jury that decided her case where she was charged with DUI. But to continue to act in an official capacity until the Florida Supreme Court required her to answer the question why she should be allowed to remain a judge was the felling blow and rightfully so.

    It’s been a while since I’ve checked in to see what’s going on in Broward but I see that Ole Cindy has finally drank herself out of a job. Too bad. She was always fun to have a drink with.

    There always was something about judges in Broward that made them seek the proverbial ole worm in the bottom of the bottle; maybe it has something to do with having to make compromises with one’s judgment sucking up to the State Attorney so often and spending the rest of the time pandering to cops so you’ll get the next fraternal order of police endorsement when they have to run for office again.

    Judicial politics is always been the sleazy backbone of Broward politics. Especially if you want to stay in office pulling at that straw to the last drop.

    So very little of it in Broward ever had to do with following the law or using common sense as a judge, just keeping those dogs off your back to stay in office and locking up everybody else.

    Ole Cindy isn’t going to run into any shortage of drinking partners anytime soon at Maguires anyway. Now she’ll have something interesting to talk about .

    As for me, the sun is shining and the world of criminal defense work infinitely better and more profitable on the West Coast.
    The judges out here make those in Broward look like mental midgets.

    Imperato has had multiple chances to correct her poor behavior. Yet she has been able or unwilling to do so.
    Hanging out with felons that she has had dealings with as a prosecutor at drinking establishments over the years shows she didn’t learn from her first DUI, nor is it the behavior you’d expect from a judge sitting in judgment of others.
    The way she conducted herself after being charged with another DUI showed a complete contempt for justice, the very thing she is sworn to uphold as a judge.
    Only after she had shown her contempt for decent behavior did she show any regret at all and it appeared more contrived than honest. All this while trying to work the system to her advantage eventually to no avail.
    Then she has continued to sit as judge while wearing a monitoring device after being transferred out of the Criminal Division.
    What kind of judgment does that show and why was she allowed to remain a judge in any capacity?
    Imperato has appeared in a negative light in media reports both in the past and recently and still she is acting in an official capacity.
    Imperato should remove herself from the office as judge and issue a public apology for her repeated offenses and the embarrassment she has subjected this circuit to.
    She has proven she is not fit to serve the citizens of Broward nor wear the robe representing Justice.
