    Maybe its time for a Chief Judge that can protect incumbents from grueling campaigns? Win or lose it’s no fun for anyone and disruptive to the administration of justice. Loads of missed work and coverage by other Judges makes for lots of sorry faces. Gee whiz golly, if a Chief Judge dealt with “fragile” judicial types before there were big problems maybe there wouldn’t be so many unhappy people and contested elections. Things would be better for everyone.

    McCarthy is done. She is not liked by APDs, ASAs, her own staff, private attorneys, and other judges. She is an embarrassment to the bench and she can no longer count on Rothstein money and Birken influence to get her through.     Hopefully he wins but even if she wins he’s doing a great service. She’s the worst Judge on the bench now I believe and it’s always a stressful day when I have to go there for no other reason except she’s a micromanager who can’t do things quickly and gets all pissy and puts everyone on edge because of her own shortcomings. She makes everyone look bad because she sets the tone. Road block city. It’s like more difficult than it needs to be and when managing clients and there families and the Sao its insult to injury to have to spoon feed the one party that’s supposed to be driving the bus. Like I say he may win or lose but hopefully she learns from the experience and becomes a better person and Judge.

    I am considering contributing $1000.00 to your campaign.

    Please file a written fund-raising request with my secretary. The contribution will not be forthcoming unless the request is properly submitted and written in uncomplicated terms.

    After the request has been received, you may call my secretary, who will then be dismissive and rude. After many days or even weeks go by, she may call back, and in holier than thou tone, may offer complicated instructions on the terms via which I will entertain whether to spend 30 seconds to review your letter. My secretary is not authorized to commit to anything on my behalf, and certainly will not set an appointment without my permission. In the end I will consult with her whether you are worthy of the contribution and for general directions as to how I should behave, so be very careful.

    Once you have satisfied all of the terms, a date may be set far off in the future for me to consider meeting with your representative to give the contribution.     Once your treasurer is called, I will harangue and carry on about some irrelevant minutiae, and generally make the treasurer fell small for no good reason. I could also decide at the last minute to not contribute, or impose additional nonsensical terms at the last minute which will cause further delays. Of course if your treasurer is an old friend of mine or someone I need help from, things will go smoothly.

    Prosecutors raised no objections to his latest two trips, with Broward assistant state attorney Stefanie Newman telling me that LeVin “has done everything he’s supposed to do,” since beginning his sentence in June 2011.

    “It’s beyond insulting,” said Broward public defender Howard Finkelstein, whose office represents the poor. “My clients in prison don’t get to visit sick parents or go to weddings. They’re in a different legal universe.”

    LeVin has traveled without deputies or guards, required only to check in by phone with his probation officer. He has to take a drug/alcohol test when he returns. Before leaving on his latest trip, LeVin was allowed to remove his GPS ankle monitor.

    “The airlines say it interferes [with their navigational systems] and can’t be worn in flight,” Bogenschutz said.

    Ah, rich convicted killers. They’re certainly different from you and me. Or at least they seem to get treated differently.

    Checkbook justice for Ryan LeVin

    Consequences have been in woefully short supply for LeVin. His 50 traffic violations alone place him in an elite class of serial offenders. He was sentenced to two years in prison for the 2006 incident, in which he hit a Chicago police officer with his car and led cops on a chase on the Kennedy Expressway.

    He was on probation for that incident when his Porsche 911 Turbo, speeding down State Road A1A near the Fort Lauderdale beach, jumped a curb and sent the two pedestrians flying. The damaged Porsche was found abandoned on Interstate 595. LeVin told police a friend had been driving.

    The judge said the need for restitution outweighed the need for prison. Some legal experts say she could have extracted both; others say there’s no guarantee juries would have convicted LeVin or found him civilly liable, so the widows were wise to agree to the deal.

    It’s galling that this financial transaction went down in a criminal courtroom. LeVin pleaded guilty to leaving the scene of a fatal accident and two counts of vehicular homicide. The judge’s job was to assign the crime a punishment. This feels more like a price tag.

    But that wasn’t the case for Maximo Gordon, to whom McCarthy gave the maximum sentence. Gordon, who doesn’t have a steady job, was represented by the public defender’s office. Stacey Gordon said the judge chastised her husband for a lack of remorse.

    “Maybe if we had millions of dollars to pay, our family would still be together,” Stacey Gordon said. “Then again, there was no victim to pay in his case.”

    LeVin didn’t appear particularly remorseful at his sentencing, either. McCarthy had to order him to remove the gum from his mouth at one point. He never said he was sorry.

    The outrage over the LeVin sentence keeps percolating. It’s made headlines in the British tabloids and is the buzz of the Broward courthouse. I’ve spoken with several other judges who are flabbergasted by the light sentence. Prosecutors say they will not appeal, saying it wouldn’t be in good faith and there is no legal basis to challenge McCarthy’s ruling.

    The question I’ve heard most from readers the last few days is, “How could Bogenschutz’s campaign work for McCarthy not be a conflict and grounds for recusal?”

    McCarthy disclosed the link when she took over the case, but the prosecution didn’t make an issue of it.

    “Right after she transferred to criminal court [in January], she called a sidebar and told us about it,” said prosecutor Stefanie Newman. “She said, ‘If you want me to recuse myself, I will.’ But we didn’t ask.”

    Here is another problems for Judge McCarthy. David Salomon is well-liked by everyone in the courthouse. Notice, not one negative post on this blog. Not one. When is the last time you have seen that happen? He also is smart, hard-working, and respectful of others. Those qualities will be on full display on the campaign trail and Salomon will have plenty of volunteers lining up to help him with his campaign. On the other hand, Judge McCarthy has less influence and less funding due to Rosenthal/Birken issues. Doesn’t look good for the incumbent. Doesn’t look good at all.

    The Feds are looking into a claim by scamster Scott Rothstein that he had influenced Broward judicial appointments with campaign contributions, according a source familiar with the investigation.

    The judges are not suspected of anything.   

    On January 26, 2009, Rothstein and his law firm Rothstein Rosenfeldt Adler gave $100,000 to the RPOF.  Two days later, Judges Carlos Rodriguez and Barbara McCarthy were appointed by Crist.

    McCarthy had connections to Rothstein’s law firm but we didn’t find proof that Rothstein’s influence led Crist to appoint her to the bench. She was married to long-time Broward Judge Arthur Birken — his son Shawn Birken worked for Rothstein’s firm but was among employees not charged with any wrongdoing.

    In 2009 as she faced an election, McCarthy’s first campaign treasurer was Rothstein law partner Stuart Rosenfeldt. After the scandal broke, she replaced Rosenfeldt and returned donations from him and a few other Rothstein lawyers. Rosenfeldt laterpled guilty for his role, which included illegal campaign donations.

    Bogenschutz said the prosecution and victims were anxious for resolution because “the case was starting to fall apart at the edges.” If it went to trial, there might have been plenty of reasonable doubt and an acquittal.

    But that doesn’t mean McCarthy had to be so lenient once LeVin copped a plea, even if it would have scuttled the civil settlement. A criminal judge has a duty to be fair to society as a whole, not to facilitate financial security for victims.

    LeVin ran over a Chicago policeman and then led authorities on a wild expressway chase, a few years before those two British businessmen had the temerity to get in the way of his speeding Porsche along A1A at 2:30 a.m.

    Or the way he behaved immediately after the incident, calling up a friend to ditch his car, then lying and obfuscating to investigators for a long time afterward.

    Or the way he stood up and took the rap for his actions last week. LeVin never bothered saying sorry, but he did sign the two hefty checks.

    “There is no recourse,” Finkelstein said, “other than to make sure the judge isn’t re-elected.”

    McCarthy was elected to a six-year term in 2010. Her deputy campaign treasurer? David Bogenschutz.

    But she just doesn’t understand the law. If you finally explain the law well…She doesn’t follow the law. Nor is she trying to learn the law. These are not good characteristics for a sitting judge. You also can’t speak in her courtroom or stand. So you really can’t speak to a prosecutor in court. But they spend so much time in court that you can’t catch them in the office out of court to speak to them on a case.
    She also doesn’t take pleas on calendar call days which all adds up to nothing ever gets resolved in there. So basically stay out of her courtroom if you can!

    As I recall, the Hispanic Bar in the recent past did nothing but try to save Fromer Judge Gardiner from herself before she was defrocked from the bench and fled to parts unknown with new hubby and then married and also her attorney concerning her problems with both the Judicial Qualifications and the Florida Supream Court, David Bogenschutz.
    The Hispanic Bar is filled with night crawlers looking to advance themselves at any expense with little care for what is right beyond their own gain, so I have little respect for any past president of that association who’s looking to knock off another poorly performing and frankly in my opinion whacked out BROWARD judge like McCarthy.
    Better watch out what u ask for, bubbys, because u might get it.
    Broward doesn’t need anymore political pimps looking to suck off the public trough. Just good judges need apply and basically ones that know how to serve the public interest and not just their own interests.

    Dave Solomon is a nice guy who is making a naïve decision. McCarthy has some huge advantages in this race. Women always pull more votes against a male candidate. Incumbents always get more money and more endorsements. The fact that she may not be popular with the defense bar will cost her maybe 500 votes out of 300,000 in Broward. She has a nice picture. Her husband is a judge who will bring in influence and funding. Her name comes first on the ballot. “McCarthy” has a nice ring to it. She is a democrat but her name has a republican ring…best of both worlds. She has a New York background. She has been through a campaign before…this will be Dave’s first rodeo. And while the Hispanic vote is huge in Dade, it’s not as powerful in Broward. Sorry folks…this one is not even close. The Broward electorate stretches a lot further than just 6th Street. David would make a great judge…I hope he chooses a better seat.

    Seidman was defeated by a FEMALE opponent whose name came FIRST on the ballot. “Seidman” doesn’t have the same name appeal as “McCarthy”. Seidman was not married to a long-time circuit court judge. Seidman couldn’t post a pretty picture on his ads. Seiman had no New York connection.     Faren had more baggage than an airport warehouse. McCarthy has a bad ruling in a DUI case that will barely catch the eye of the electorate.     David is a wonderful person and would make a fine judge that some other judges could learn from but unless he runs a more aggressive campaign than some others who have taken on the established order of political birds in black he has little chance of winning. Jara made the mistake of thinking he didn’t have to and look what happened to him. He would have made a good addition to this bunch of judicial misfits as well but he didn’t get the picture from the beginning and lost several times. These people play nasty and you’ve got to be ready to take them on because they can easily be beat by the right person with all the baggage that Broward judges seem to carry around like its a badge of honor.

    I laugh every time I see some idiot yapping about “the courthouse vote”. There are over a million people in Broward County, and only a couple hundred pool,we who work in the courthouse. It’s like grabbing the votes of a big church. Wake up people…the “courthouse vote” is barely worth a candidate’s time. An election is not about popularity…its all about numbers, and numbers are not in “the courthouse”.

YET CHIEF JUDGE WEINSTEIN DOES NOTHING BUT OFFER FEEBLE EXCUSES AND DOES NOT IMPLEMENT NEEDED CHANGES TO IMPROVE THE ACCOUNTABILITY OF BROWARD JUDGES LIKE JUDICIAL ROTATION AND A HOST OF OTHER CHANGES THAT ARE SORELY REQUIRED TO STEM THE FLOW OF POORLY PERFORMING JUDGES ALL STEMING FROM A COMPLETE LACK OF JUDICIAL OVERSIGHT AND PERSONAL HUBRIS EXHIBITED REPEATEDLY.     Broward Judges want more money and more judges ? That’s a real laugh. When u see what littl they actually do, you’d ask yourself what the hell for ! They do next to nothing and want to do even less for the exorbitant amount they make ! Ask chief judge Weinstein what he does with his time as well as numerous others who have no dockets, no cases, no nothing ! Then ask yourself why we need anymore judges in Broward county. A complete audit of judicial schedules will tell the real and true story ! Then get rid of a third of them and watch number of cases being brought to final disposition remain the same! Then call your congressman and ask them why Broward county needs more judges !

    Just dropped in to c how things are on the Old Broward Courthouse scene. Sorry to c things haven’t changed. Can’t say I miss any of the crap over there. Things look worse with everybody wanting to slurp the judge thang as business has dried up and the pie gets smaller ! Lol. Being a judge in Broward is like giving up the ghost and riding the dragon into the ground! Things are much more fun on this coast and the pay is much better ! I’ll check back to c who’s lookin for what soon.

        Broward Judicial hangers on are famous for milking taxpayers to the last drop. Don’t even ask why they never do anything or why courtrooms remain empty most of the time and then they ask for more judges because they’re overworked because it’s almost as ridiculous as the game they play.
        Broward needs a complete judicial overhaul with continued oversight starting with the Chief Judge who carries little or no caseload as they do in other circuits and does little else to monitor the wasteful practices that continue to plague Broward Courts.

    I hope that Birken leaves soon. He is very quick to rule against normal fathers, order child support, and then leave kids without fathers. He refuses to enforce his own orders when the mother refuses visitation. His whole disposition is effectively “so sad too bad”, and l’ve heard the same from a High School buddy or two in their cases. Quite a few attorneys have cited him as a fair judge, but I don’t see what could be fair about a judge who screams at you in court if whether you are silent or say even one word. Maybe some fiduciary interest? Nah.
