STEP UP TO THE PLATE, PETE

The Sun Sentinel Editorial Board has issued an editorial entitled Protect public from bad actors on Broward bench .  Click the link to read it. 

The following excerpt is from the editorial:

Everyone deserves a second chance. And like any citizen, judges accused of wrongdoing are presumed innocent until proven guilty.

But until their cases are decided, these judges should not remain in a position to affect people’s lives.

Chief Judge Peter Weinstein should be clear in this message to all judges. Serving on the bench is a privilege, not a right. And while suspensions create havoc with dockets, it is essential to maintain high standards at the people’s courthouse.

To be clear, we’ve confirmed from multiple sources that Weinstein has failed to date to issue any circuit-wide statements to the judiciary concerning the legal and ethical problems facing Imperato, Pollack, Rosenthal, Watson, or former chief criminal judge Gardiner.  He’s also failed to respond to our questions explaining why he won’t implement programs or training for judges to help understand the extreme stresses of deciding people’s fates, and the potential for substance abuse problems.  And Weinstein’s not said anything at all to his judges or the general public signifying “bad actors on Broward bench” will be dealt with decisively and severely, in order to both reassure the public and deter future aberrational judicial behavior.

Nobody wants Weinstein to step down.  In fact, all anybody desires, judges included, is for Weinstein to step up and demonstrate to the community the ship has a captain, and that five embattled individuals haven’t sacrificed the moral and ethical high ground the vast majority of the 17th Circuit’s judges occupy through dedication, hard work, and leading exemplary lives.  But if Weinstein can’t show at this crucial time that he possesses the desire or ability to lead, then he should step aside for someone who can, just as one of his predecessors did way back in 2007 …

    Don’t care much about your not caring about Chief Judge Peter Weinstein stepping down.
    The man has obviously done nothing but promote the unconscionable behavior of Broward Judges since he’s been acting as chief judge.
    He should be asked immediately to step aside in favor of another judge who will show more concern for the public. After all, all of these judges are being paid by public funds; many of them do next to nothing, the others drive drunk or show up on the bench inebriated and yet Weinstein has done nothing but hide or offer lame excuses as to his own lack of leadership, all the while asking Tallahassee to fund additional judges that are not needed, again at additional public expense.
    Broward Judges should be made accountable. Judge Weinstein has and will do nothing to correct this problem as he courts their vote to be re-elected as Chief Judge. It’s now despicable.
    Now it is time to replace him and put in someone competent and with the will to correct these terrible judges and their outrageous behavior.
    Chief Judge Weinstein needs to step down immediately and an investigation conducted to see exactly what is going on in the 17th Judicial Circuit.
    This outrage has gone on long enough. This is not a game like some judges like to play.
    REMOVE PETER WEINSTEIN AS CHIEF JUDGE AND RESTORE CONFIDENCE TO OUR JUDICIARY.

    Attorney Alfreda Coward just made the following comment to the Sun Sentinel, about Rosenthal – a sitting judge:

    “She acts as if she’s still a prosecutor. “

    I thought it was clearly settled that attorneys cannot impugn the integrity of a judge? And, when they do, the Bar is supposed to reprimand that attorney?

    Ms. Coward better hope Jack Thompson doesn’t see this – he might forward the article to the Bar.

    Oh wait, anyone can send such info to the Bar anonymously when attorneys make these types of comments …

    p.s. Ms. Coward – that whole ‘truth is a defense’ stuff doesn’t apply to lawyers. And, even so, you actually don’t have anything factual or tangible to base your attack on!

    Remove Weinstein, that’s hilarious to suggest that the chief judge is responsible for every judges behavior. Everybody is in their mid fifties, Weinstein should have stayed outside of Rosenthal’s house,cased the bar where Imperato allegedly got a little over cooked, or maybe he could have followed Giselle from rehab completely ridiculous If you are going to assess blame start with the three individuals whose actions have landed them on the front pages

    The same old story for protecting the status quo. Oh, woe is me, poor little old Chief Judge does the best he can, don’t blame him. He can’t reassign Judges to the dungeon when they sleep with lawyers in their courtroom. He can’t ship them to a satellite when they blow off work 2 days a week every week. He can’t rotate them so they don’t become burned out wrecks alienating everyone. He can’t call a press conference and tell everyone what he’s doing to stop them from falling drunk off the bench. Little Chief Judge doesn’t answer to anybody and neither do his Judges because he will always have their backs no matter how embarrassing or incompetent they are. It’s no wonder lawyers hate coming to Broward because the little puppies let the big dogs pee all over the place.

    Wonder has there been a Chief Judge in the history of Broward who knew of a Judge that violated the Canons and failed to report it to the JQC? Riddle me thus Devil Dog!!!

    The Chief Judge IS responsible for the actions of the Judges. However, the inmates in the asylum run free. Someone has lost their cajones to stand up to the judges and it started at the top.

    What other CJ in the 17th Circuit had to deal with all the garbage that’s going on there today? > < that many, because today's shenannigans wouldn't have been tolorated for one moment. When the people at the top fail to be role models, you can’t expect the rest of the group to act accordingly.

Are you trying to say some war hero, who leads thousands of enlisted men and officers by example, who is related to the future Governor of Florida, who does not have roots in the Ken Jenne Ana Gardiner infested swamp of yesteryear, who is a gentleman, and not lazy, could do a better job than the current CJ?

    Judge Fry? All that guy did downtown was try cases. With him in charge Judges will be expected to work full days, until, gasp, 5:00 pm!! Judges will be expected to help other Judges out and try cases from other divisions if free. Lawyers will be expected to work their cases out quickly, or try them in an environment where they know their clients will get a fair shake and a reasonable sentence if found guilty. Police will know they can’t lie on the stand and Motions will be granted when they do. This will be bad for everybody because lazy lawyers won’t be able to string their cases out forever to get paid and lazier Judges won’t be able to take naps at home by the pool in the afternoon. Worse yet, Judges too stupid or lazy to keep up will be exposed and GASP face opposition from credible candidates. The public will be served instead of raped……..the public will respect the Courthouse…………ARE YOU CRAZY MAN??????
