UPDATE

Jack Tuter’s war on the jail cap continues unabated -the hotly anticipated Administrative Order implementing the Alternative Sanctions Program for probation violations was issued yesterday for felony offenders and misdemeanor offenders Click on the links to study the specifics.

Adam Goldberg, chief of the Public Defender’s Early Representation Unit, told us in January that the statutorily authorized program is already in place in numerous judicial circuits throughout Florida, and should have the effect of clearing a large amount of non-violent probationers away from jail stays when a technical is presented to a judge.  The judges retain discretion on each case, so warrants could still be forthcoming, as with the request for reprimand letters in lieu of warrants process, which has been in place for some time.  With Tuter leading the way, however, it’s hoped judges won’t interfere with alternative sanctions, and allow the Department of Corrections to handle technical violations in house.

Wait and see …

Constitutional Revision Commission Chris Smith spoke to us this morning regarding an update on the CRC and judicial issues.

The push to get the retirement age up to 75, and doubling the qualifying minimum years of legal experience before becoming a judge from five to ten years, may still make the ballot.

However, merit retention for all county and circuit judges, after having to face one contested election, seems dead.

Smith says he supports merit retention for seasoned judges because he’s unhappy with the current system for electing judges.  He doesn’t think they should have to hustle all over the county without being able to say much of anything after surviving their first election, but mostly wanted to start a discussion about changing the way judges are elected.  After facing strong resistance from the other commissioners, Smith said the next step may be to try and alter the restrictive speech rules governing judicial elections, so candidates for the bench can at least have substantive discussions on the campaign trail …

Glad someone else said it, was tempting but not the point.

First, what was 70yrs. old 40 yrs. ago is really not the same now.
People are living longer and unless something is wrong with you, why not. The experience can be worth a lot.

Merit retention is a good idea. Why not drug testing. For LEO’s too.

If a person has to take a drug test to get a job as a plumber, electrician, or carpenter; shouldn’t the ones we entrust to do administer “Justice?” also need to do that?

That is NOT funny! I was always so proud to work with such an intelligent and professional group of attorneys in our courtroom, but I have discovered through your musings what a cruel and ruthless bunch you can be. I was privileged to work with two of the finest judges on the Broward bench and I will stand up for either of them any day of the week. Shame on you.

I say make it merit retention. That would put sick pressure on all new Judges. First time up everyone of the JNC’s appointed Judges would get an opponent.

Merit retention in a single county jurisdiction would allow wealthy organizations and individuals to easily superfund a Judge out of of office.

“Arresting and incarcerating certain non-violent offenders for minor and technical violations of probation is both expensive and nonproductive.”

Power pigs live for power. 75 or 95, a pig can’t let go. Throw a bucket of pig food and you’ll hit them in Broward too. It’s not only DC.

Judge Tuter is showing great courage and responsibility for making these changes. No judge has done this before in Broward County, It seems no one has had any interest the the extreme financial cost of keeping minor probation offenders in jail days, weeks, and even extended periods. To fully understand the problem you must understand that the mind set philosophy of the current probation officers in this county. They are trained and conditioned to violate everyone as soon as possible. They are even instructed by their supervisors like Eric Simpson to make up violations in order to punish those they don’t like. This is a major step forward and a great improvement.

It simply makes me sick that the people creating, governing, and enforcing laws on citizens are doing some of the most vial crimes.

If it isn’t the lawmakers, it is the “white collar” people funding those actions, or the entertainers that promote their “special order” (aka propaganda).

I just cannot believe all of this runs so deep within the system. America has evidentally been sick for a very long time…Seems like something that would happen in someone else’s country, but not ours. It is a scary thought to even raise sons and daughters in this kind of world.

It is an outrage that the Mayor refused a free audit by the Florida bar. I have not been politically involved in my city and I regret it. I am glad that Plantation residents are becoming more involved and aware of what is going on in our city. Let’s not forget the commissioner that also voted against the free audit. I would like to hear what the reasoning for that was. Also- why is there no evaluation on the city attorney? I’m looking forward to seeing who comes forward to help lead our great city.

Talk about a whack. It’s scary. Satz hires incompetent airhead bimbos over qualified, talented people. The only worse run public office is the Public Defender’s Office. There all the top paid people don’t even carry caseloads because they are too incompetent to even walk into a courtroom. It’s hard to believe and even scarier to comprehend.

We only mentioned him because of the story. Have a lot of respect for him. Think he’s one of the very best. Just happens the real guilty one was represented by him and don’t believe his clients would approve knowing what they will find out.

We tell the truth, we are not responsible for other peoples actions or the consequences those actions may bring. We want to help someone clear their name a little.

Haddad only did his job. “He” did nothing wrong.
