WEDNESDAY NOTES

Switcheroo! – the rumors regarding Andrea Gundersen being pushed out of Family are true, and for all those fretting about her coming to Criminal, rest easy. She’s going to Dennis Bailey’s current Foreclosure Division #11, and Bailey is taking Gundersen’s Family Division #41. As far as Raag Singhal’s coveted former Civil Division #21, it’s being babysat by Mark Speiser until the JNC fills the vacancy created by Singhal’s call-up to The Show, with Raag’s replacement now likely coming to Criminal to take over for whomever wins the behind the scenes wrestling match to win admission to 21 Club. Today’s AO is found here with the three changes …

Save the date!Gina Hawkins JQC trial is coming up, set for February 13th in the central courthouse. There’s been lots of back and forth on the docketing of this case, with former ASA Greg Lauer now a listed witness in support of what he categorizes as his former trial partner’s “playful actions.” All docs are found here

Busted! – Clerk’s employee Sheena White got indicted by the Feds, suspended without pay since January 3rd of this year. The Indictment is found here. It’s unknown at this time if the allegations have any type of connection to White’s employment responsibilities.

Jason Maraj, one of Brenda’s higher-ups at the Clerk’s Office, recently beat a felony gun rap, ably repp’d by courthouse go-to-guy Jeremy Kroll. The PC Affidavit is here, No Info’d by the SAO’s Alex Urruela back on December 13th. Kroll also represents former ASA Alim Babayev on pending DUI allegations before Bobby Diaz, with Zeb Goldstein defending Babayev against a civil auto negligence complaint stemming from the same alleged DUI incident …

BOG Platform Statements – there are three races for BOG this year, and the platform statements are found here. Interestingly, Michael Shelley, running in the 11th Circuit, shares similar concerns with “(t)ransparency and consistency in discipline cases,” writing “the Bar seems to be focused on constitutionally protected free speech rather than actual misconduct that harms the client and the public at large.” Check out all the statements, including Jay Kim’s, and be sure to read this Q&A with TFB president-elect hopeful Michael Tanner, regarding legal challenges to mandatory bar associations, as previously highlighted via WSJ link on JAABLOG here

Served!JAABLOG is ensnared in Bryson v. Scherer, due to this post from May of last year. Marni’s attorneys are looking to invade the journalist’s privilege, but not if Pro Bono Warrior John Howes has anything to say about it. Check out this objection John filed back in December, and we’ll be sure to update after this Friday’s scheduled depo …

Whose mother do I have to hire around here to get a nolle prosse? – that’s the bad joke going around the courthouse these days, after the SAO dropped some serious 1st degree felonies, and then refiled them. The cases had been in ASA Jeff Chukwuma’s name, while the defense attorney was his mom, Laura Chukwuma. Needless to say, Jeff wasn’t the ASA that dropped the cases, but the incidents have been the talk of the SAO, where morale is even lower than the usually normal all-time-low, due to the perceived closeness of Laura to Mike Satz.

We saw Jeff Marcus and Satz last week and asked if they knew anything about the matter, since it was our understanding that police officers involved in some of the cases may have been the first to make the stink that led to the refiles. Marcus and Satz were predictably uncommunicative, so we went to the SAO’s PIO later that day, who replied last Friday:

Here is the Broward State Attorney’s Office response to your questions:

As you know, cases are automatically assigned by the degree of felony and the seniority level of the prosecutors in each courtroom/division.

Assistant State Attorney Jeffrey Chukwuma was removing himself from cases where his mother was the attorney of record, as required. We recently discovered that while he was removing himself from those cases and giving them to other prosecutors to handle, his name was remaining on the case as the assigned prosecutor.

This was corrected after it was discovered and Mr. Chukwuma was counseled to officially have the cases reassigned to avoid any appearance of impropriety.

Among those cases were one case involving two co-defendants and a separate case involving one defendant. Those cases were randomly assigned to Judge Siegel’s division, where the defense attorney’s son is the lead prosecutor.

Because of the conflict of interest, another lead prosecutor from a different courtroom/division was asked to handle the above cases. That prosecutor was absent from court because of a missed flight and yet another prosecutor was asked to step in (at short notice) and handle the court hearings.

After speaking briefly with the defense attorney, the prosecutor was under the impression that charges were to be dismissed against all three defendants and that one of the three defendants had agreed to plead to one charge in exchange for time served.

Upon review, supervising prosecutors disagreed with the dropping (or nolle pros) of the charges against the three defendants and those charges were re-filed. Supervisors also disagreed with the disposition of the charge that had been pleaded out but it was not possible to re-file that charge.

Our prosecutors are continuing to review the matter.

The cases involved were:

17-8678CF10A and 19-2084CF10A Wiky Jean

18-13535CF10A Berlin Millicent

19-2138CF10A Tiffany French

All but 17-8678CF10A have been re-filed.

We’ll be sure to update after the SAO finishes its review …

I guess the state is short prosecutor. That what happens when you run every case to the ground knowing the defendant is innocent. Even the prosecutor don’t want to put with satz. Is this guy gone yet? Will he dictatorship practice ever change or will Broward end up like its own sewer and water systems. Broken. I would miss my flight too. Go find other poor morale prosecutor to do your dirty work. I’m voting Rydell or Kimok Broward needs desperate help.

Another former criminal judge moving to family how sad. First was Rothschild now Baily. I guess family will be the retirement for these lousy Judges it’s a shame they will be deciding children’s future based on their demented criminal background. Every parent will be a defendant tuter you should be ashamed of yourself who is paying you to make these moves??

Sheriff Tony has already curtailed some of the faulty and frivolous arrests thereby saving The SAO a bundle, > $$$ and also the judicial terror towards the public at the hands of tyrants.

      Thank you Sheriff Tony. 🙂

Has Kroll ever represented Diaz in any matter? If so- wouldn’t that need to be disclosed? Not sure if he has or not. But it’s interesting.

Nolle prosse in Broward lol. Better chances of snow. Even if the prosecutor and pd are mother and son. I’m surprised it got notice before conviction in Broward. Usually the 4th has to uncover these issue. Prosecutorial misconduct is just another day in Broward. Dade county would never allow this. That’s why cowards come to Broward.

A few times some on this blog have accused us of not liking judges and prosecutors because we didn’t like the way the criminal case against one of us did’t turn out the way that person wanted.

The response from us was that person did not like the way he was treated, and his wife on one occasion were treated as VICTIMS!

      Maybe now some get it.

Cowardly Casey. Can someone send him back to Miami. He wouldn’t pull this corruption in Dade. That why he came to Broward. He ran on not being an activist judge that how he got elected. Unfortunately he changed he agenda after reward. He is on path to be the most activist judge in Broward. Why would he cap to get elected?

Let me get this straight: Merlino got suspended for nothing over the June Johnson case and Chulwuma was counseled?

Satz: I thought I told you to change your name now they know that’s your mom.
    Chulwuma: I’m sorry boss.
Satz: hopefully they don’t appeal the sentence that was disposed already through your deal with your mom.

I heard Schneider has the cases now. They must be on high alert. Surely that can’t be good for the D’s. She’s a badass. Since Coach and Holden left, the only class act left over there.

Chukwuma is a very common name.
Any ASA could have overlooked it.
Boy, it sure was nice of Mike to let him choose the other ASA’s to handle the cases once he figured it out.

Just get this spoof a pair of socks and a suit that’s not two sizes too small before he’s allowed back in Court …

    3

Oh, Bill… You forgot to mention Chukwuma “reassigned” his mother’s cases to two ASAs who were very chummy with Chukwuma and his mother. You also failed to mention that he attempted to place the blame on his predecessor for the abhorrent plea deal that he, by proxy, gave to his own mother. Consciousness of guilt, one could argue.

These were cases in front of Siegel. ASA Joe Gilday was the lead for forever in there. Did he make those offers? What does he say?

I wonder how many of these “oopsies “ were done at the hands of Chukwuma. Only way to know would be to request all of his nolle prosse and change of charge memos… except he doesn’t do them, and receives no reprimand…. muhahahahahahaha!!

Gordo cried…yes broke down and cried talking about his juvi works, staged sympathy, just like he did at the Cruz press conference.

    Then there was this exchange…

Moderator: How many jury trials have you had in the last 5 years?
Gordon: I am in court all the time, been in court multiple times this week.
Lynch: Gordon, that didn’t answer the question, how many jury trials have YOU done in the last 5 years?
    Gordon: none
Lynch: I tried 90 jury trials in 4 yrs as a pd and presided over many more as a judge.

    1. 29

      0

Like nobody knows already that Gordon Weekes hasn’t done anything for his entire career as an asst. pd under Finkelstein but avoid doing something ? Howard has turned that office into an affirmative action committee for the legally inept. Lol

    2. 6

      7

Sounds really petty and desperate of Lynch.

I heard Lynch came across as a racist p.o.s. because of that report he was the harshest sentencer of blacks.

And why does Lynch keep focusing on his love of water sports?! Even Lori Parrish keeps telling everyone how Lynch ‘loves water sports’ – wtf does that have to do w anything

      1. 20

        0

The better question is who cares what that airhead Lori Parrish has to say about anything ? All this coming from that trailer park debutant ? Between she and her former Broward judge hubby, for a lack of any talent on both their behalf’s, they milked state coffers for everything it was worth without making a single improvement to anything they were ever involved in.
Its these types of trough suckers who have never been able to do anything but grease the oily palms of anybody who would do anything to help them line the inside of the pig sty.

      2. 9

        0

Thanks Lorena, don’t worry I wont mention to Gordon how you keep letting people who know Lynch, be aware that you would have no issue working for him

        1. 13

          0

You chose your dog in this race Lorena and now you want to cover your bet ? You’re as dumb as your little lov fiddle.
Afraid you’re stuck with the dog food.
If you spent as much time actually working as you do trying to play both sides of the fence, you’d be a much better attorney and earn some respect, but to switch ships in the middle of a storm when yours is going down shows us all we were right about Gordon and right about you.

I just love my water sports. Now excuse me while I change my diaper.
As an old fart and Former Broward Judge with fingers still sticky from the days of Moron Ross and The Gang of Four, it’s obvious I’m the best qualified candidate in this race.

And while my qualifications speak for themselves, I want to get to know you better and at the same time pull down another whopper salary to recoup a big pile of cash I had to pay to my ex-wife after I went bimbo crazy.

I like to water surf because of the health benefits associated with hydrotherapy.

Did I mention my bambino son is also a Broward Circuit Judge? He may be a little slow, but he gets the job done.

And I can unequivocally tell you that courthouse bimbos keep you young at heart even if they are expensive.

Look for me on the campaign trail. You can’t miss me. I’m the one that looks like an old burnout hippie with that hungry look.

Everyone knows Public Defender Supervisors don’t do squat. That includes not having any caseloads. What they do do is provide a network of informers to report to Howie (when he even comes in) all the malcontents that are ripe for the picking. That makes up most of the office where everyone is overworked and underpaid except for the PD Supervisors who get paid the big bucks, some after entering the Drop Program and are back for still more. Most of this practice was clapped into place by Howie’s adopted mommy Keuthan with the blessing of Howie.

    1. State v. Leon Reid, 08-11866CF10B. First degree murder conviction reversed, 6/21/2017. Reason: “The prosecutor shifted the burden of proof to the defendant during closing argument.” Prosecutor’s name: Gregg Rossman.
    2. State v. Phillips Pierre, 08-11866CF10A. First degree murder conviction reversed, 2/7/2018. Reason: “The prosecutor’s closing argument improperly shifted the burden of proof to the defendant and invited the jury to convict the defendant for failing to call a certain witness.” Prosecutor’s name: Gregg Rossman.
    3. State v. Anthony Ferrari, 05-15875CF10B. First degree murder conviction reversed, 12/7/2018. Reason (one of two): “The state’s failure tp comply with its obligations under the Rule of Criminal Procedure 3.220, by neglecting to disclose the substance of a codefendant’s statements as well as the existence of exculpatory statements by another witness, constituted a discovery violation.” Prosecutor’s name: Gregg Rossman (in collaboration with Brian Cavanagh).
    4. State v. Anthont Moscatiello, 05-15875CF10A. First degree murder conviction reversed, mandate issued 10/2/2019. Reason: Hearsay evidence improperly admitted during trial, and featured prominently in both the opening and closing arguments of the state. Prosecutor’s name: Gregg Rossman (in collaboration with Brian Cavanagh).

prosecutor Robert Carney, Anthony Caravella, Frank Lee Smith, John Purvis, and Christopher Clugston. the undeniable fact is that Carney;s had far more than his fair share of involvement in bogus murder convictions, then as a judge: Knight v. State, 672 So.2d 590 (4th DCA 1996), Bacon v. State 672 So2d 658 (Fl. 4thDCA 1996), and Williams v. State 677 So2d 113 (Fl. 4thDCA 1996), the Fourth District Court Of Appeal reversed the convictions and sentences in a cases presided over by the Honorable Robert B. Carney for prosecutorial misconduct and Carney allowing it.

I believe Judge Tuter means well, but in the video to students he says acting out can hurt one’s chances of getting into the Armed Forces “or worse” college.

Our military heroes are the greatest gift we have as a Nation. They are the ones giving others the freedom to go to school and do other things. Please bless them.

      1. 37

        0

Besides being a jarhead political junkie as Chief Judge in a County that has had more problems with its Judges than anywhere else in the State, Judge Tuter has done nothing but make lame excuses for the bad behavior of Broward judges and used the Judicial Shell Game of moving the worst offender Judges into different Divisions in attempts to obviate the Shame and Provide Cover for Judges that should more appropriately be sanctioned, disciplined and removed from office.
No. Tuter is the same kind of sleazy political gamester in a long list of Sleazy Political Gamesters who have made this Judicial Circuit the Laughingstock of the State of Florida, even adding a few more unimaginative elements to strain the credulity of observers.
I guess that’s why he’s called “Tooty”.. Broward Judges that run afoul of their responsibilities Toot their Horns, and it’s Tooty that runs to the rescue and provides the Cover.

        1. 3

          4

I don’t agree with all that but I must say for him to devalue military service by putting it below good jobs or college is rather offputting to say the least. It may be a generational thing as those from the Vietnam era as Judge Tuter appears to be may hold views about the military that are still influenced from that controversial time. Its difficult to say what the issue is with his statement but he should issue a clarification because military service is a higher calling than any other service including legal service or being a police person or a student with the exception of those people studying to be public school teachers.

Buddy, you give Howard too much credit. Howard is a politician and, like any politician, he has an agenda which he is just as crafty in advancing as any paid consultant. His appears to incorporate a real antipathy towards law enforcement and, in particular, our State Attorney, Mike Satz, who is retiring at the end of this year after more than forty (40) years of public service. For many of those years, Mr. Satz has endured a steady stream of criticism from Howard’s soap box. I suspect that Howard’s attitude towards law enforcement dates back to 1987 when, inebriated, he plowed his Cadillac into a parked police car. Howard was not a twenty-something who lost his way, but a well-known member of the Bar with the reputation of a flamboyant litigator – an officer of the court. Howard’s arrest was big news. So were the cocaine and prescription drugs found in his car and the charge that he somehow obtained a court order to retrieve drugs held in evidence – drugs he was alleged to have pocketed. You need connections, cunning and real chutzpah to pull that off – facts that were not lost on Jeff Marcus, Mr. Satz’s rather reserved chief assistant who prosecuted the case. Marcus had him dead to rights and wanted convictions and prison time, but with the aid of a very skillful defense attorney and a nod from a sympathetic judge, Howard pled to probation, avoiding felony convictions, prison time and being disbarred. I wonder if Howard thinks he got his break at age thirty-four (34) because he is white and was a member of the Bar or if he somehow deserved it as he argued back then. Two things we know for sure: (1) Howard has frequently accused the State and judges of disproportionately punishing minorities; (2) Howard is not a minority. Have you ever heard Howard cite his own case as an example of disproportionate punishment? Howard got another break when Al Schreiber, Broward’s Public Defender at the time, took pity on him and hired him as an investigator. Howard began cultivating his image as a defender of the downtrodden, eventually succeeding Mr. Schreiber as our Public Defender. Along the way, as you noted, Howard became somewhat of a TV personality, appearing regularly on Channel 7 in “Help Me Howard.” Mr. Satz’s stoic forbearance over the years stands in stark contrast to Howard’s loud, bombastic pronouncements. Howard’s approach has certainly brought him much publicity and made him a bit of a local celebrity or, as you put it, garnered him a “ginormous” following many have been reluctant to take on – which brings me back to my original point. Buddy, you say Howard speaks truth to power. I would argue that: (1) what Howard speaks is his truth – that which is convenient to him; (2) that Howard is often the heavyweight in the fight and (3) that maybe you have a blind spot where he is concerned. You are spot-on though in one respect: Broward will miss Howard for the entertainment value.

The Khazarian Mafia (KM) wages an international effort to eradicate Kings who rule by the Divine Right of God Almighty:
Because the KM claims to have a personal partnership with Baal (aka the Devil, Lucifer, Satan) because of their sacrifices to him.

Think Jeff Epstein and The Florida Bar.

The Khazarian Mafia (KM) originally stole their magic show from Africa. And then they perverted it.

I’ve worked with many Israelis, mostly soldiers.
I can say that most are aware that they are being played.

The Khazarian Mafia (KM’s), under-pinning of support here in the states and most of the world, comes from Christians who obey the Jesuit (think military branch), teachings. Think Catholic’s.

So how does this work? If Baal is the Devil/ Lucifer/ Satan and the Baal Shem Tov is the Besht who is the Jewish mystic and healer from Poland who founded Hasidic Judaism and means “Master of the Good Name” or “one with a good reputation,” are the Chasidics the masters of the good name in name only, like satz, are fakers?

              Point made.
              But,
I’ve see the daily Jewish struggle between The Torah and the Tulmud on the bench.
Both totally opposed. You can’t have both.
We got a bundle of Jewish judges, and who could argue that its important to know epistemological aspects of any sitting judge in space/time i..e a judges mind-set given a set of axioms.

The strong Jews will always side with Torah.
Despite respective conditioning aspects in culture, the common threads in history suggests,

      Just a politician like you?
Google judge Matthew Destry and you will find this politician’s at the top of page one. The politician that took a bribe by accepting endorsements from a Pompano activist group? The one the voters chucked and stalked us here on this blog?

        SFC and Bar Members,

The JQC and The FLBar uses the Boss Hogg method.
This is why no Bar Member wants to ever file charges.

Sarahnell needs to return all that campaign money from the Chukwuma family in light of her accepting nolle proses on cases she corruptly procured for her clients! Satz tried hiding the corruption for his good friend who funneled campaign doe to him for countless years. We are all watching. And if he thinks the Feds aren’t going to get involved he is sadly mistaken. No one trusts a BSO investigation. Thanks to Gelin for continuing to shine a light on Satz corruption.

You have to watch out for those Feds. now since thanks to some of your judges here in Broward, wherever we comment, they follow. They are not just watching what we say either probably.

You have a hard time believing they paid us a visit over the Watson Videos?

Don’t think they wanted to find some conspiracy between us and him?

Think they also might have been interested about the very specific threat to potus made on our YouTube channel? Like we said, they are watching.

That’s been a couple of years now, guess we could post the threats on YouTube that were made. Never told anyone here about that one.
