WHO YOU CALLING A CLOWN?

Peter Weinstein sent the following email to all judges Tuesday afternoon.  He seems to have taken great offense at Howard Finkelstein’s comments to the DBR relating to the new AO, although Weinstein attended a meeting with the Public Defender at roughly the same time judges discovered the chief judge’s missive in their inboxes, described by sources as being “conciliatory and cordial” to Finkelstein.  Oh well, it is an election season for the embattled Weinstein, who may be reacting to criticism that he takes too many punches instead of throwing them on behalf of his badly bloodied judiciary.  Oddly enough, most of the judges we’ve spoken to believe the email backfired, making Weinstein appear overly defensive and, as usual, slow to react, and may have ultimately cost him votes come February.  From our perspective, he’s also opened a can of worms, since we’re now obligated to ask Dave Simmons, Jorge Labarga, and others a lot of tough questions to clarify some of the strong assertions Weinstein makes in the email regarding the genesis of the ground-breaking and historic AO that seem to conflict everything we’ve learned thus far.  And the beat goes on …

I am writing in response to the article entitled  “Chief Justice’s Order Says Buck Stops at Chief Circuit Judges.”  The article contains statements by Broward Public Defender Howard Finkelstein wherein he describes Broward judges as “misfits” and the Broward court as a “clown house.”  These comments are not only offensive and highly unprofessional but simply untrue.  Mr. Finkelstein’s statement that the Supreme Court’s recent Administrative Order entitled “Diligent Performance of Judicial Duties” was issued because the Supreme Court is unhappy with Broward judges is a complete misstatement of the facts. The Administrative Order does nothing more than reiterate what is already the law and as spokesman for the Supreme Court Craig Waters states, was issued to simply remind the judges throughout the state of their ethical duties.  As a member of the bar for over forty years and completing my seventeenth year as a judge, I am disturbed by an elected official such as Mr. Finkelstein making such comments.  As a young attorney, I always aspired to become a judge and am proud of the service I and my colleagues are providing to the people of Broward County.  Every single day people appear in our courtrooms to have a multitude of problems adjudicated by our judges.  As I said in the statement I issued in reference to the problems encountered by three of our judges, the judges in Broward County “are hardworking, conscientious, and do not condone in any fashion any sort of impairment or substance abuse that would prevent their handling of each case that comes before them with the utmost care, consideration, and attention that every case deserves.  We recognize that judges make serious decisions affecting people’s lives each day they are in court and that with that weighty responsibility comes a duty to be fully accountable.”  I stand by that statement today as I did then.

    Simply put, Weinstein having done nothing to discourage the outrageous behavior exhibited on behalf of a growing number of Broward Judges, he has made the situation much worse.
    His apparent inability to bring Broward Judges to task for so many things, not to mention insisting they show up to work for starters, when he carries no work schedule of his own insofar as handling any cases whatsoever, shows clearly to anyone paying attention, that his real focus is not where it should be and he is not serving as any kind of good example.
    Chief Judges should be responsible for the judges in their circuits, not playing politics and making continual empty excuses for judges who have made Broward the laughing stock of the State of Florida.
    This guy has been on the public dole one way or another for his entire career, so when he talks about his so called service to the public, he should take a hard look at the real problems facing the Broward Judiciary instead of being in large part the reason for many of them.

    I heard Horowitz will carry a division. True? If so that makes him a better leader right off the bat. Leadership is defined by example.

    Judging by the way Broward judges having been behaving lately, don’t know why u should expect anything else from CJ Weinstein. CJs have always been the same in Broward County. Remember how Sticky Ross never did anything but bunk up for all the moron judges no matter what they did? Weinstein is just as bad. Just another backslapping, self congratulating public servant riding the wave of do nothing until retirement kicks in! LOL

    Weinstein was a do nothing in Tally and a Judge by default after his dreams of going to Washington were dashed. At least Horowitz is a hard working Judge who became a Judge after being a full time lawyer. Whatever he does as Chief I know his day and night won’t revolve around ribbon cutting ceremonies and being a fly on the wall at political functions. Vote for change and if change doesn’t occur vote Horowitz out too.

    Describing Broward judges as “misfits” and the Broward court as a “clown house.” is clearly a bar violation. Howard should be treated as any attorney

    “I really believe judges will do what they need to do, which is police themselves”, Simmons said, “and if they don’t, we’ll look at it again.”

    I WOULD WELCOME THE OPPORTUNITY TO APPEAR AND SPEAK TO ANY PROPOSED SENATE JUDICIAL HEARINGS AS WELL AS BE QUESTIONED

    Howard certainly has brass balls. I have a hard time understanding why he wanted to have all the judges in the circuit pissed at him (calling the courthouse a “clown house” and implying that the judges are all clowns is not exactly subtle) but maybe it is about time that somebody upsets the status quo over there. Unfortunately, Broward County has for too long been an incestous little cesspool, always envious of its more famous big brother (Miami) and jealous of its richer Uncle (Palm Beach).

    Weinstein has been little more than an embarrassment since taking the position of chief judge. The only thing that is more embarrassing is the way he dodges any real work by pretending he’s somehow involved in monitoring the rest of dodgers in black. Being lazy seems to be a prerequisite for the job! If he did something besides concern himself with toilet seats in the new courthouse, I’d have a little more respect for the guy ! As it stands, he’s no solution to any of the problems facing the Broward Judiciary. More like he is the problem.

    WEINSTEIN COULDN’T FIND A PIG IN A POKE UNLESS IT WORE A DONUT NECKLASS. HE GETS A BIG RED VOTE OF NO CONFIDENCE. EVEN THE BAD JOKES THAT ARE MOST OF BROWARD JUDGES HAS ITS LIMITS.

    It’s going to be an interesting election. Will the misfits prevail and vote Weinstein back in at the Clown House. Or will the hard-working judges have enough votes to vote Horowitz in and get every judge working, especially the satellite slackers.
    I’m rooting for Horowitz’s worker bees, fearful of things getting really bad if Weinstein is elected.
