      Peter Weinstein is taking his old trial suit out of mothballs to defend Judge Contini. Like the one Cousin Vinny used to rescue his wrongfully fingered client. Things ought to turn out well.

    That is the best argument the AG could make? Howard Finkelstein please run for State Attorney.

    They follow their own criminal code-what about the police who plant drugs on innocent people yet face no charges? What about the SA’s use of dirty confidential informants? What did they do do about the Gardiner case? What did they do with cases that were before Rosenthal? What about the unethical threat of minimum mandatories to force scared people into taking a plea deal.

    How often does the AG or State Attorney meet with judges to discuss procedures without the PD present. Contini did not Ex-Parte, this is about the State Attorney not having a lackey Judge rubber stamp cruel and unusual punishment.

    Not every case In the division qualifies for a downward departure. Very few do. So how can the SAO move to disqualify him on every case?

    Bad writ on an issue with legs. I do think the disqualification is to every case as he is sue sponte downward departing on cases with no motion pending. This writ is poorly written imho.

    The 4th DCA will deny the writ of prohibition PCA and everybody goes back to work. Ho-hum . I think it is about Satz saving face.

    I think it may be a fireside chat issue and maybe a disqualification on a couple specific cases they mention in writ but no blanket.

    The State is correct in its acertion. Judge CONTINI erred in his actions and should be prohibited from hearing any and all criminal cases.

    Interested and affected parties (other defendants ands their counsel) should file a Motion to Dismiss and Motion to Strike the State’s Petition for Writ of Prohibition, primarily because taking the attitude/position of waiting to see what the 4th does, i.e. find the Petition legally sufficient, seldom serves the waiting party well. (Their judge is being attacked in overreaching attempts to replace the judge, by their own prosecutor) It seems if we are involved or passionate about opposing this odious power grab by the State Attorney, other defense counsel should let the Appellate Court know of their standing and feelings. The Court can easily and mistakenly perceive that the lack of a response is a laissez-faire attitude, an implication that other affected parties don’t particularly care if the Judge is forcibly and unconstitutionally removed from the Criminal Bench — which is exactly the effect of the State Attorney’s actions.
    We must destroy these seeds of thought before they take root in the Fourth District by aggressively opposing this Petition. It seems that the initial attack can be comfortably premised on basic Constitutional principals interwoven with “real world” common sense practicalities.
    There are rudimentary and historically based “separation of powers” arguments, usually dredged up by the State, which should end this problem quickly and finally based on the method the State chose to attack you. Just as the State Attorney has virtual unfettered discretion when making decisions regarding who to prosecute and how to do it, the Judicial branch of government enjoys a necessary autonomy. The State is attempting to directly impinge upon the functions of the Judiciary, specifically, the assignment of Judges within the Circuit. The State is not concerned about your fairness/bias, but rather, the State is trying to control the assignment of Judges to the Criminal bench, actually

    Hasn’t Contini reduced his case load to number 3 from number 1 jus three short months ago? First to arrive, last to leave, it always seems like it’s the Republicans you find in the Judicial parking lot long after the courthouse closes.

    Contini sticks around late enough, he may as well have a night court docket. Defense attorneys and others should defend Contini against the likes of Mike Satz.

    Do I hear “Contini for State Attorney” in 2016? It’s time for Satz to retire.

    You’d think with as little as Broward judges actually do, they wouldn’t continue to screw up as often ! They have the lowest case counts in the state, and yet Weinstein continues to ask for more unneeded Broward judges to milk at the public trough. Broward judges continue to be the biggest jokes in the state with Weinstein at the head of the pack of slackers. Why doesn’t Weinstein have a docket like other Chief judges in the state ?

    I’ve read the comments on this thread, some thoughts:

    You need to give up the Democrats/Republicans bullshit. Everybody knows who are the judges that work and the ones that don’t and partisanship has nothing to do with it.

    I don’t think the 4th DCA will get involved. I think they will PCA Contini’s denial of the motion to recuse. However, if they do grant it, say goodbye to the criminal division, Judge Contini.

    Lastly, some people need attention all the time, for example OJ Simpson, the guy who killed Trayvon Martin and last but not least Jay Hurley. I have never seen such an attention craving person in my life. If I were Judge Weinstein I would take him out of first appearance. He is the perfect example of how people act up when there are tv cameras around. Yes, he has a cult following, but he is an embarassment to an already much-maligned judiciary. Magistrate judge is very simple and easy job, An 8th grader can be taught to do it. Indeed, ALL the judges doing it by rotation on the weekends and holidays.
    The only reason Hurley is there is because no one wants that position. By the way, Judge Hurley, that magistrate position you have that allows you to work less than 40 hours a week.
    If you are working 12-13-14 hour days, you are extremely inefficient.

    Bad judgement and Broward Judges seem to go hand in hand. I’m frankly surprised The Sun Sentinel even ran this article after turning a blind eye to so many Bad Broward Judges for such a long time. All The Sentinel has done is pander to these misfits. I guess the situation has finally gotten so bad that even this second rate paper can’t ignore it !

    Based on this I believe that the SA should never meet with any Judges without the PD present. This includes any and all emails/phone calls that the SA with the Judges. Even if it is only procedural…

    after reading the motion i tend to agree with the state in so far if their position was to administer justice. however since the state’s position in broward is soley to prosecute, then NO. our justice system is based soley on the administration of justice. judge contini seems to follow that concept.
