COME ON, JACK!

There will be no Broward courtroom named for Chief Judge Jack Tuter in the near future.

And there will be no courtroom named for the late Public Defender Al Schreiber

So starts Buddy Nevins’ article from earlier today over at BrowardBeat, titled Courtroom For Late Public Defender?

Buddy continues:

Naming the courtroom for Schreiber at this time could be interpreted as an insult to Chief Judge Tuter, whose honor was stalled, according to (Broward County Mayor Steve) Geller. 

“We don’t want to get into a naming war,” the mayor says. 

So the naming issue seems dead for now.

No Tuter courtroom. No Schreiber courtroom. Just a courtroom.

The whole thing started after JAABLOG sent the following email to Tuter on Monday, with the subject line Al Schreiber Ceremonial Courtroom Request:

I am writing to ask if Chief Judge Tuter would support naming the Ceremonial Courtroom for the recently deceased Alan Schreiber.


I am not attempting to be impolite on this issue, given the fact Commissioner Bogen supports naming the courtroom for the chief judge.  However, given the stated, on the record concerns of a large number of Commissioner Bogen’s colleagues about carving out an exemption to the Broward County Administrative Code to allow the facility to be named for a living person, together with the towering presence Mr. Schreiber still exerts over Broward courts, I am hoping the chief judge would support such a measure.  Most assuredly, without Chief Judge Tuter’s blessing, it may be next to impossible to find a commissioner willing to execute the necessary sponsorship to put the item on the agenda for obvious reasons, so it is greatly hoped the chief judge will graciously step aside and support the measure.


If you could please let me know soon, that would be greatly appreciated.  In the meantime, if the chief judge would like to hear from other lawyers in support of naming the courtroom for Mr. Schreiber, I can make arrangements and gather signatures, if requested.

Unfortunately, and predictably, there was no response from Tuter, prompting this follow-up email yesterday:

 … At this point I will assume there will be no further response, and that the chief judge will not be supporting my request to either withdraw his name from consideration or to support naming the Ceremonial Courtroom for Mr. Schreiber. 


If I’m wrong, please let me know.

So there you have it. Buddy’s reporting has verified our concern that the County Commission would be reluctant to replace Tuter’s name with anyone else’s, even someone as accomplished as Big Al. And that’s a shame, since the chief judge could exercise humility and leadership and support the measure, which would most assuredly get it done.

Now, of course, it’s up to everyone Al helped to make their feelings known to both Tuter and the County Commission. We’ve contacted many prominent attorneys already who have promised support, and are waiting to hear back from BACDL. Together, honoring Al Schreiber in the manner he unquestionably deserves should be something that can transcend politics and be accomplished in the near future.

        I’m still trying to figure out exactly what Jack Tuter does. He doesn’t have a docket like other chief judges in other circuits. The guy is absolutely useless as far as I can see. There must be more productive things to do as a chief judge than politic all day. The rest of the judges think he’s a mooch and don’t have any respect for him and the taxpayers are getting a raw deal for what he’s getting paid to do nothing.

          Weinstein was a completely useless and self serving waste of a robe but if they’re considering breaking the rules for Tooter because he helped get a construction project done then Weinstein should get something since all he did was go to new courthouse building meetings and oh boy if it should go to someone then why not the working men and women who actually pounded the nails and put in an honest day’s work.

    Alan should be honored. Stan Kaplan should be honor. Howard Zeidwig should be honored. Those judges, in my book, deserve the honor of having a courtroom or wing named after them. There are plenty of courtrooms for Tutor’s ego but please let’s not forget those who carved a legacy in our system and are utmostly respected.

    Miette Burnstein was the county’s first, and only, woman chief judge. She may have been the first female judge in Broward, too. If any jurist deserves this, it’s her.

      Bernstein was Larry Korda’s sister, the Broward Judge that was busted and lost his job for smoking weed on elementary school grounds. Like the rest of the Broward Judge Squad, he just took his pension and disappeared after that.

    The courthouse should be named after Mr. Terry Stiles. He was an amazing ethical man! He is truly the man who saw the vision for this county and is the one who built this courthouse. Terry Stiles should be the name for this courthouse!

          Doubtful. Jack was a big nobody then. He ran against Kaplan and Thurston. (Thurston had worked for Al.) They kicked his butt. Thurston was ultimately beat by Kaplan in November. I think after that was when Jack hooked up with Scherer’s firm. He was appointed shortly thereafter. He then became chummy with Tobin and Weinstein. Peter delivered him the CJ spot. The rest is history.

    Since shutting down the courts due to Covid I don’t see any talented lawyers making big money but I have seen private law practices closing their doors, big law firms laying off lawyers, many having to down size to smaller offices and having financial hardships since health insurance per month is more then we were making. Not to mention many have had to sell their vacation property because they couldn’t afford them. Thanks Broward for ruining our lives and retirements.

    I don’t really care what Tuter’s preference is. Just wish he’d grow a pair of balls and do something, anything to improve the State of the Judiciary in the 17th. It’s beyond a joke here where there’s no Judicial Rotation, Continuing Judicial Education or the slightest oversight of Judges who don’t work but for a couple of ours a day if that, repeatedly show up late for Court and spend the rest of the time politicking or padding their wallets by teaching on the side at Nova. It’s disgusting the way Tuter chooses to ignore and provide cover for this type of behavior. Courtrooms remained empty even before the pandemic with judges nowhere to be found in Broward. We have a new courthouse with no judges working. Tuter isn’t doing his job.

    Don’t name it after Tuter or Schreiber or Ross. If we want to send a message for future generations of lawyers, let’s name it after a real pioneer who spent a career working for equality and justice, and always fought for the highest ethical standards: the late Judge HENRY LATIMER.       Working at Scherer’s firm, working for Judge Weinstein as his #2. These are two of the most distinguished men in the legal game in Broward. Scherer’s success in both the political and private sector is unprecedented. Judge Weinstein had the most distinguished political career in Florida politics before unifying the judiciary and getting the Courthouse built. I think it must be difficult for a man like Judge Tuter. Having lived in the shadow of great men for most of his career. For owing so much to them. I would imagine there must be a level of insecurity involved because of it. The odd move for the dedication of the Courtroom could be motivated by this. To make him feel good inside. I would understand but I don’t agree. It’s not fair to truly deserving individuals. It’s not fair to Scherer or Weinstein. It’s not fair to the other Judges serving with quiet dedication. I feel I understand Judge Tuter’s feelings but I hope the legal sector can move forward and leave this embarrassing episode behind. This was a egregious show of poor judgment.
