DIAZ WHIFFS

Bobby Diaz and his friends don’t seem to like media coverage.

First there was Bar v. Blog back in 2013, when Diaz and Marni Bryson focused complaints were dismissed by the Bar without direction.  “That’s not what was done in this case” former Bar director of lawyer regulation Ken Marvin told the Sun Sentinel.  “An inference can be drawn from the fact that no letter of advice was issued.”

Next came the complaint against Larry Meltzer for holding his ground against Jill Levy when his mother-in-law was bravely facing down her final days (see transcript page 29/40).  This too was summarily dismissed by a Bar grievance committee, with no public comment from Levy, a known compadre of Diaz.

Brenda v. Blog is still ongoing, despite the travesty exposed by video evidence.  Forman has been close to Diaz and his wife, Dian Diaz, a one time high-ranking officer at the Clerk’s Office.

Lastly, a complaint signed by Diaz against Adriana Alcalde was dismissed today by a letter to the complaining party that seems sympathetic to Alcalde, pictured below, together with relevant portions of the original complaint.  Diaz put his name to the complaint on August 29, 2018, one day after his August 28th election victory over Michael Heise.

Read the letter carefully.  It’s hoped the Bar may have had enough of these types of frivolous complaints against good lawyers, as seems to be indicated by the chosen language.  In any event, we’ve frequently brought the ongoing issues to the attention of anyone who will listen, including Howard Finkelstein, who stated earlier today:

We are well aware of the disturbing patterns playing out with the Broward judiciary and the Bar, and it has not escaped my radar screen.

    Judge Fahnestock is the most unjust, unprofessional Judge is Broward County. She made a ruling that is to the detriment of two innocent children. She gave 50/50 timesharing to a father who was verbally, physically and emotionally abusive to the children when they were toddlers. He caused one of the mothers children to have ptsd. The mother has taken care of the children by herself since they were born in 2008 and the father only filed for custody when the mother received an upward modification in child support in 2014 with failed service then again in 2016. Judge Fahnestock states in the final judgement “the father claims that the mother has stalked him and destroyed his property, which has led him to conceal his address and contact information from her” first and foremost how do allow a strange father 50/50 custody when the mother has no knowledge of his residence?! You tell the father he must update his address with the court so that he can receive a copy of the order but nowhere in the order mention he must provide his address to the mother prior to ANY visitations. Secondly, the matter of the fact is that obviously he is a drug dealer and was arrested in 2017 as the officer testified in court and that is the real reason why he is concealing his address because the environment he lives is NOT SUITABLE for children. Third, the mothers former supervisor that worked at the Clerk of Courts called her into the office to let her know that there was a police report faxed to hr stating the mother had damaged the fathers property and that hr investigated the allegations and know that the mother was in fact AT WORK at the time the fathers claimed witnesses saw her damage his car. Judge Fahnestock heard evidence of the fathers anger in a recording and still gives the father 50/50 timesharing. I dont know what kind of environment her children in but if she thinks the conflict and anger of the father is not detrimental to the children maybe she should have her children around him instead of putting two beautiful innocent children in the line of danger. It is so sad that she is going to rip these children from their safe and stable home to a very dangerous environment. This is where the system goes wrong when the life of a child is lost by a judges unfair and unjust ruling. Judge Fahnestock did not follow the law and did not do what was and is IN THE CHILDRENS BEST INTERESTS. MARK MY WORDS YOU WILL SEE THE OUTCOME OF HER UNJUST AND UNFAIR RULING. Not too mention the father has not visited nor called the kids within months before the trial and to present and the father does not answer the mothers messages for months on talking parents, nor the supervisor to see the children nor f.a.c.e.s when they try to contact the father but the Judge wants the mother to continue “talking” to the father when there is no line of communication to the father. Yet Judge Fahnestock believes the children should go to the father 50 percent of the time. No other reasonable person would reach the same conclusion Judge Fahnestock reached. She is disgusting and sickening. Judge Fahnestock also called the mother a liar when the mother told her she had gotten the deposition date after the date had already passed. The attorney gave her 3 days notice to appear at a deposition that was emailed and mailed to a pobox which the mother did not have enough space in her phone to get the notifications every day and would check her emails every few days. What judge allows an attorney to give a 3 days notice to appear at a deposition? The mother was prose and the Judge allowed the attorney to not only set the deposition unilaterally but scam the mother out of the money she needed to care for her children. Judge Fahnestock ordered the mother to pay $1009 to the fathers attorney fees for not getting the notice in time to attend I know the mother very well, not only does she work for judges she is the most honest, kind and loyal person I know. She does not lie and she takes pride in her work. Her children adore her and they are going to be devastated being apart from their mother which they have NEVER spent not ONE night away from their mother. The mother makes 26k a year while the father makes 110k a year. The judge ordered the father to claim one of the children from 2021 until they become of age when the father did not even ask for that in court. Yet, the mither did not receive any attorneys fees she asked for neither did the judge even care to order any help for the children. As evidenced by the talking parents, the father does not want to pay a penny for the kids school project supplies neither an epipen yet the judge feels the father should have more money for himself rather than make sure the children have what they need. Judge Fahnestock needs to come off the bench!!! We all need to keep our children safe and it will not be done with this Judge on the bench because she is obviously not doing whatbis best for pur children. The father was repeatedly caught lying in court to her face but she rules in his favor after witnessing his demeanor?!?! Judge Fahnestock you are incompetent and I pray nothing happens to these children because of your unjust ruling!! Our children have rights and we can not allow this judge to take our childrens right to a safe an healthy environment away!!! We need to Get her off the bench asap please Chief Judge Tuter!

    That is horrible. I know exactly who you are speaking of. It is very devastating to hear that because I know her children and I know what the father has done to those kids. Very sad. The mother has been working for the clerks office since 2011 and she really is the most respectful, kind and helpful person. I remember one time he dragged her daughter by the hair when she was 2 years old. We all should come together to have Judge Fahnestock removed.

    Is this bar complaint a joke? Judge Diaz wrote it. Truthfully, this complaint is grammatically incorrect and a mess. The fact that it’s written by a sitting judge speaks volumes of his work. He should be grateful he has a judgeship. He couldn’t make it in the private sector.
    If it were a Motion I couldn’t charge a client for such a poorly worded Motion. I suggest he and all Broward judges
    dedicate more time to being in court and going through the cases on the docket. He should also consider not being disrespectful to female attorneys. Old school macho much? Get over your feelings of inferiority. You’ll be much happier.

    He’s seen Rafael hundreds of times. But in his courtroom he doesn’t recognize him? Is this a case of short term memory loss? Stop.
    My free advice: try keeping a low profile for a few years.

Judges have an obligation to report unprofessional conduct. The bar then decides if there are grounds for reprimand.

        I’m a legal lightweight struggling to earn a living. My big claim to fame is calling a judge names on this blog and then being humbled by the supreme court. I learned my lesson and know how to bend over, making me the ideal candidate for PD.

              And good thing Conway took a simple reprimand. The Supreme Court later intervened and asked for briefs – so he got the benefit of S.Ct. review after all.

              The S.Ct. ended up affirming without a written opinion, so he lucked out not having to pay all those trial fees the Bar would’ve required, yet he still had all his arguments heard by the court.

              So try another angle Ruby, that one doesn’t work. What are you so scared of anyways?

    If Diaz spent as much time on the bench as he does wandering the halls looking for recognition, he might actually get more done. Instead, we have a chief judge asking the legislature for more judges in Broward. Its an upside down administration making lame excuses for errant and lazy judges.
