DBR – Broward Judge’s Contempt Order Against ‘Disruptive’ Defense Attorney Reversed (3/1/21)
The 4th DCA today reversed and remanded the contempt order issued by Jill Levy against Mickey Rocque. The SAO conceded Levy’s error in taking Mickey into custody prior to the hearing, and the remaining issues will now be heard by successor judge Mindy Brown. The opinion is here.
Congratulations to Mickey and Fred Haddad, who prevailed based on this bang-up brief. The SAO’s answer brief is found here.

Like nobody does Contempt properly. They must stop listening at Baby Judge School when they say Contempt means the Court has lost all control of the proceedings don’t ever do it. Yet some still try. Then botch it all to hell.

I wonder why they Remanded? The Disq issue was moot; on the evidence they could have ruled. Now there’s going to be a big show. Judge Levy won’t look so good IMHO.

Bailey was messing around with a trial, in front of a jury. Roqe was only a hearing. Since there’s only a handful of trials a year in 17, they like to keep them clean.

Notice how the 4th didn’t PCA the case because it involved an attorney. This is an issue that should already been known as a matter of law. They PCA cases with defendant’s that has a clear case for remedy. I smell bias towards defendant’s.

It’s plenty briefs out here where the State admitted on the record in favor of a defendant yet a PCA was STILL issued. Even if they weren’t to state it on transcript, you would have to be a real idiot to believe that a prosecutors OPINION or position OVERRIDES the LAW. How can you refute the record transcripts that clearly shows it’s in opposition of the law. Wipe your eyes.
