SCHERER: IN OR OUT?

Rumors have been flying all week as to the possibility of Liz Scherer quitting the Broward circuit bench.

It all started Monday, after some good-natured comments in open court from Liz strongly hinting at bigger things to come in her future.

Given her recent media ubiquity, many speculated a departure could be media related, but that doesn’t seem to be the case.

Other rumors center on Scherer leaving for private practice at the family powerhouse firm of Conrad & Scherer, either locally or in the North Carolina office, nearer to where Liz’s equestrian passions are focused.

Accordingly, the following email was sent to Scherer and to her judicial assistant this morning. A similar email was also sent to Bill Scherer, managing partner of Conrad & Scherer. None of the emails have been answered as of the time of this post:

      She should have never been the judge on the CRUZ case to begin with. A judge with much greater experience and temperament should have been assigned the case. Tuter screwed up on that one.

        This continues to be one of the stupidest comments on this blog—and that’s saying a lot because MOST of what’s on here (in the comments section at least) is moronic. Cases are assigned randomly. The Chief Judge can’t pick a judge for a particular case no matter how “special”. If the attorneys thought the assignment wasn’t random, and if they wanted a different judge, they could move to disqualify on those grounds. Here the case went to Judge Scherer and whether you feel she did poorly or did well, this blame for Judge Tuter is ridiculous. I’m sure there will be a response or two disagreeing with this, and I’m sure no verifiable facts will be cited. Same as it ever was.

            I agree. Like many I feel Liz simply didn’t have the experience to sit on a case of this magnitude. It proved to be true rather consistently. Judge Tuter should have foreseen this.
            Didn’t Judge Tuter used to work for her father before he became a judge? Didn’t Judge Tuter lose an election only to be later appointed just like Judge Liz Scherer?
            That says a lot about why such an inexperienced judge was allowed to sit in such a case.

    It’s probably the best option she has seeing when she has to run to retain office she might very well be voted out. I don’t think many voters are happy about the way the Cruz case turned out or the way she conducted the proceedings. She tried but I think she just didn’t have it in her considering how unprofessional the defense lawyers were. She probably regrets the day she ever became a judge in Broward. Needless to say, there are a few other judges that feel the same way.

      Voted out??? 🤣🤣🤣 No matter what the ten criminal defense lawyer voters on this blog think, Judge Scherer is wildly popular among the general voting population who would have preferred the death penalty. Even taking the 9-3 vote, that means 75% of the voters wanted Cruz dead. Whether you feel she did poorly or not, if she wanted to—and I doubt she does—she would win an election in a landslide.

        I’m not so sure of that. I think she may have problems due to the verdict and what a lot of voters may think about her lack of maturity and experience should she decide to run again. I for one don’t know why she’d want the hassle for so little dosh. She’s clearly in my opinion not suited for the bench but if every judge in Broward were removed that fit that mold, we’d have even bigger idiots seeking the position. Look at what we have now.

      1. There’s stress and pressures from or above or even the JQC is on her like for Judge Seidlin following a big nationally televised embarrassment
      or
      2. The terrible nature of the Parkland case made her say: ‘life’s too short’
      or
      3. She’s already handled the biggest case in Broward history. At a young age too. Why not go make some real money since there’s nothing left to prove (like Polston).

      A Judge can utilize discretion at will. That’s a non-factor. What I can’t understand is the absenteeism. The tardiness. JT allows it.
      The fact is she collects a paycheck. But how often is she in the Courthouse.
      Judge Bryson was JQC’d for much less.

Her constant absences (especially with zero notice) is completely uncalled for. A complaint is 100% warranted for her tardiness and absences. Truthfully, Tutor should also be partially blamed for allowing it.

    If Liz can’t take the heat, she should move onto something else. She’s not a candidate for political office it’s obvious. She might just move somewhere else and shuffle papers for daddy most likely. Even that will require more than a couple of days work like most Broward judges. I disagree with most posts on here that imply she’s incompetent as a judge. She’s just not cut out for sitting on her dumpling even if its only part time. She’s not unlike most of the judges here that think the job entails a couple of hours a day before heading home to work on how they’re going to get re-elected for such a cushy job. I do however think our chief judge should have never allowed such a novice handle a case like the Cruz case. He should have known better. Tuter is partly to blame. He misjudged badly.

              From what I recall: Suspension, Fine of 15 Thousand and the requirement of letters of apology to the Hispanic Bar and the offended fellow judge to which he had sent what was determined by the JQC to be the threatening email.
              Any hard work by Diaz has ever been more akin to getting re-elected than what he has ever accomplished on the bench in my opinion.
              Many judges have expressed that they would be more than happy to see the back of him for good.
              His alignment with Brenda Forman to keep his wife employed in the Clerk’s Office hasn’t done his reputation any good either.
              Bob’s tenure on the bench could best be described as mediocre at best.
              He has never been Circuit Court material neither by ability nor temperament.

    As long as we’re talking about rumors, Heard Scherer gave Tuter the push to enter the judicial carnival because he wasn’t bringing in the green. So what would he want his lazy daughter onboard for ? Liz needs to hone her kitchen skills for a good man and leave the heavy lifting in more capable hands if you ask me. I’ve always thought she was a nice girl but not necessarily a particularly good judge. Some just aren’t meant to join the circus that Tuter is running here in the 17th. The best thing that could happen is if the both hit the road in pursuit of other skill sets. There are entirely too many judges as it is that fit into the same category. Haven’t come across any legal scholars within this bunch of skaters.

    Liz was obviously led to believe that she was just along for the ride – that is until she took on the Cruz case which she eagerly thought would catapult her to fame and fortune. It was followed nationwide by media and the attention addicted Chief Judge Tuter who should never have allowed such an inexperienced judge to handle a case like this.
    He could have stepped in to remedy the situation from the beginning but didn’t. Thusly Liz was completely out of her depth from the beginning of the trial.
    It was make or break for the Public Defender’s Office, one in which all their resources went into the defense effort, probably and to a large extent the detriment of all other cases within the office.
    Liz was stuck between a rock and a hard place from the beginning. It was obvious she wasn’t up for it judging by her actions, facial expressions and rulings throughout the trial in her attempt to pander to Satz and the prosecutorial team. I mean , it was in your face if you followed the trial.
    The incident involving her stepping down from the bench at the very end and hugging the prosecutors was not only unprofessional but outrageous and showed clearly her bias and immaturity.
    Couple that with the grandstanding effort by Gordon Weeks and the incendiary statements made by the victim’s families and you had a perfect recipe for disaster.
    The point being Liz lost control of the case early on, a mistake no veteran judge would have ever made.
    It was obvious to me that she had a personal animosity against some members of the defense team, more specifically Lisa McNeil that was painfully apparent from the onset of the case.

    Judge Tuter if he had known or cared could have avoided all of this, but instead remained solely committed to his own abhorrent vainglorious naming of a ceremonial courtroom and the display of a portrait of himself.
    If he’s remembered for anything it will be his failure to properly and adequately administer the judges, a duty in which he has miserably dropped the ball and has continued to do since becoming Chief Judge of a circuit much in need of competent and dedicated leadership.
    Tuter has never led by example instead preferring to remain the ringmaster of a flea circus.

      Ordering Gordon Weeks to go to the back of the courtroom repeatedly was akin to telling Rosa Parks to take a seat at the back of the bus during the civil rights movement if you ask me.     We hope you read this. You always have been, and continue to be, an atrocious judge.

    1. You have always been blatantly biased in favor of the prosecution, to the point that you openly help them, while intentionally impeding the defense. You have consistently failed to show impartiality, fairness, or neutrality.

    2. Over the years you have consistently treated defense attorneys and public defenders with utmost disrespect! You’ve consistently berated defense attorneys and your insolence is unparalleled at the Broward Courthouse.

    3. You’ve consistently treated defendants in a cruel and callous manner. You have consistently failed to consider mitigating circumstances or you have sentenced people/denied them bond in a cruel and callous manner that was inconsistent with legislative intent.

    4. During the pandemic you stopped working (or did little to no work) for weeks at a time. You would refuse to hold court. You would further refuse to even hold bond hearings. You callously allowed hundreds of in custody defendants to rot in jail while REFUSING to have bond hearings.

    5. You disregard your responsibilities as a judge. For example, during the pandemic you would refuse to hold court because you were “riding horses” in the Carolinas. Then, when you would hold court, your internet would “go out” because you were in a “remote area”. You would then disappear and not return, leaving dozens of attorneys and defendants without an opportunity to be heard. Notably, you would do this despite showing up an hour late on the bench. Even recently, you continue to act in this manner.

    Overall, your cruel, callous, and condescending conduct violate the judicial canons on a near daily basis. Therefore, it is exciting to hear that you may be resigning, because frankly, your conduct has always been unbefitting of the black robes.

        Ana did not give a shit about destroying Mary and Dave’s marriage. Ana is only out for herself plain and simple. One of these days, Dave will wake up and wonder what the hell he was thinking. I wonder if he has already had that thought. Ana never cared about who or what she destroys along her path. Plus she had all types of people defending her who were supposed to uphold the law which always confused us as to why Judge Holmes and her predecessor Judge Moon still stick up for her after all these years. And now everyone knows the truth because of the overwhelming evidence yet these two judges still wanted their BFF back. Makes you wonder if the JQC should be looking into their character to serve on the bench too. Hmm maybe it’s not to late for one sitting judge .

            Ana was and is a predatory Kunt who committed felonies on the bench for the fun, pleasure and support of Satz and Bob Butternuts. She started there. and never stopped for 10 years. The problem is, her offenses committed against innocent defendants were never allowed to come out, because then it also put Satz in the front of them. Her conspiracies with the ASSAs and Satz to compromise cases were always protected by scum like Raft and Donnelly, and even Finklestein and Cuddihy, when they were really so very bad, Even the PDs office and the compromised 4th DCA had to lend a hand. She should have been in prison long ago. BUTT as long as the Courts and Judges refuse to follow the law and act in a fair and impartial manner, she will suffer no Karma, and she lacks the conscience to care.

              Yes she did ruin his firm too. . Like I said she destroyed everything and anyone, but one day Karma is going to get her.           The problem is that she was on the bench at the time and involved in the sexcapade…Other than that no one cares.     Not every one who has an affair is bad or to blame. My marriage was a mess, sex was so far and in-between it didn’t matter because I wasn’t attracted to her any way so I stayed for my kids. The “other woman” was intelligent, cute, a hard worker and always had pride in the way she looked. I think of her every day and miss her more then you can ever know. My only regret is that I didn’t get a divorce and have some love and happiness the rest of my life.

      If you have an affair and betray your spouse you are a weak coward. And YOU are to blame. It doesn’t matter if you liked your spouse or not. It doesn’t matter if the sex was good or not, or if you felt neglected or unloved. You could have worked on your marriage or left the marriage. Cheating is living a lie.
