    What is wrong with “double dipping?” Exhibit A serves for 20 years in the Marine Corps, earns a 1/2 pay retirement, goes to law school and works for the Miami SAO. Should he forfeit the retirement he earned? Exhibit B serves as a cop in Lauderhill, earns a retirement, and goes to work for BCSA. Should he forfit the Lauderhill retirement she earned? Exhibit C works for Broward SAO for 40 years, earns a pension, and retires. Why shouldn’t he be eligible to apply for an open position? Why do folks get so angry at other folks who earn a retirement?

      After soaking taxpayers for their entire careers and inhibiting anybody else from moving up in the ranks, then they want to come back and soak them some more all for the sake of maintaining their positions and keeping the status quo ?         Well the news is out-Dade County will give ALL their SAO employees a raise. Each county was allocated funds for raises. But what happened to Broward SAO employees- it’s going to the dream team. There is no justification that the 6-figure folks (after retirement) continue earning 6 figures. As they continue to soak the SAO funds for the Parkland prosecution, obviously it’s for their own greed, not for the sake of these families or the community. Nope, not fake news! Hey wake up – there are really great and committed employees at Broward SAO but there is no appreciation, as yet to be shown. Let’s not forget that it’s been years since there were overall increases AND in 2020, the healthcare coverage will cost more, so even less money spendable income. Par for the course.

    Monica Hofheinz was clear that her plan was always to work for SS Solutions and come back after DROP well before Parkland occurred. It was cited as a reason she still cared about the office—because she didn’t actually have one foot out the door despite being so close to retirement. Pull emails and text messages and start looking for witnesses. If she mentioned it in casual conversation, there’s surely a paper trail to show this is a lie.

                    Oh, come on, Murphy is one of the best SA’s we have. Pragmatic, honest, tough when necessary and prudent on alternative sentencing on appropriate cases. In my experience, I have always seen her decisions be akin to actually a pretty good clinician as well as a great jurist when determining if a Defendant should be given some leeway and perhaps a second chance.

    A few comments concerning the bringing back of senior ASA’s: DMS in Tallahassee as authorized such action and many other SAO’s in the state have done what is being done in Broward to insure successful prosecutions in the most serious of cases. Mr. Morton was the head of homicide and clearly knew the Ibar case better than anyone so it made sense to request he come back to lead the prosecution effort rather than have folks start from square one. ASA Hofhienz has years of experience in Tallahassee in gaining successful funding for the office which clearly is necessary for the Parkland case. ASA Donnelly was a capital crimes prosecutor prior to heading public corruption which involves the prosecution of public officials including LEO’s such as Peterson. Thus he’s fully aware of how the Peterson case will involve parts of the Parkland case in addition to the new penalty phase of Ault given the change in death penalty law in Florida. ASA McCann is a statewide respected death penalty appellate lawyer who has the respect of former AAG Brill, Nunnelly and the current head of the state AG’s office of capital appeals. Chief Assistant Marcus was in capital crimes for a number of year prior to his current assignment where he continues to handle select capital cases. The bottom line is that these folks continue to follow the mandate of Mr. Satz to do the right thing for the right reason when the facts and circumstances of the case and the law requires it. Mr. Satz has always put the prosecution of his cases first and politics, media well behind. I was fortunate to be in the office for many years prior to relocating in Florida and what I learned was outstanding under his guidance. As for pissed off ASA 7/23 6: 49P some of us became ASA’s to see that individuals who commit crimes get punished when deserved, not for financial rewards. You clearly have a BAR card and can leave the office whenever you choose. I suggest you do so now. SAO5

      It’s one case. What happens to all the other cases and public safety while this one sucks up all the resources? Its important, yes. But as with Mike’s practice of prioritizing his other personal cases, the way this one is being approached has more serious implications to public safety, unless Monica can raise enough extra money to hire 20 additional experienced ASA’s and 20 more investigators to handle regular cases. Its also true they didn’t bother grooming people to replace the droppers. This would not be happening if proper planning had been done, and most importantly, if seasoned lawyers hadn’t fled the office because there was no chance of moving up. The real failure is that. There were once a lot of experienced lawyers happy to serve as career prosecutors who couldn’t take it anymore and left. The exodus left inexperienced new lawyers doing their best and the top heavy gang that is now aged out. No one in the middle, a classic sign of a failing or poorly managed firm. Now they don’t even have anyone capable of doing Monica’s job that doesn’t even involve going into a courtroom? Does this sound reasonable or is it more evidence that Mike has done a disservice by leaving a weakened office that even he feels is improperly staffed and ineffective without outside help (SS Solutions). No, he should do the opposite of what he said and immediately put people in the top slots to be mentored by the droppers for whatever time is left so at least the new incoming person has a working office that can protect the public. His obligation is to the public not to worry about whether someone’s feelings will be hurt later especially when it’s likely the new person will rely on whoever is doing the top jobs anyway.

            Although this is not Broward county, it makes our point. This is how some DV victims are treated by judges and SAO’s.

            This judge was later reprimanded by the Florida Supreme Court for this incident. We have plenty of complaints from Broward too.

            Judge jails domestic abuse victim for failing to show up to court.

            In July 2015, Judge Jerri Collins sentenced a woman, the victim, to three days in jail for not showing up to testify against the man standing trial the for domestic abuse against her.

            The woman had filed a police report in April against Myles Brennan, the father of her son, for choking her, pressing his thumbs against her eyes and threatening her with a knife. Case-file notes show that she showed reservations about testifying against him about a month before the trial. She had been communicating with the prosector and victim advocates. When she did not show up to the trial, Brennan was sentenced to 16 days in jail after pleading to simple battery.

            When the woman was back in front of the judge for contempt of court, she apologized for her absence and said, “I’ve been dealing with depression and a lot of personal anxiety since this happened.” The judge replied, “You think you’re going to have anxiety now? You haven’t even seen anxiety.” She charged her with contempt of court for violating her court order to appear at the trial.

            Jeanne Gold, CEO of a domestic abuse prevention group called The Seminole County Victims’ Rights Coalition said, “I can’t blame the state for wanting to get a bad guy, but you cannot lean on a victim of domestic violence to solve the societal issues in our world.”

            In 2016, judge Collins was publicly reprimanded before the Florida Supreme Court because of this.
