DIAZ & SCHERER UPDATE

After a comment from “Sleepy judge” on May 20th, we’ve confirmed from multiple sources that Bobby Diaz did indeed appear to fall asleep during the trial and testimony of ex-BSO Deputy/Defendant Jorge Sobrino.

We’re working on getting audio and/or video footage that may have captured the judicial reawakening at roughly 1:36 PM on May 19th. The trial was widely covered, and CBS 4 was handling the “pooled” video feed, so we’ll be sure to follow-up.

Paraphrasing, one observer had this to say:

It was clear to everyone in the courtroom (the judge) was asleep. The clerk was tapping on the glass to wake him. He was leaning back in his chair, and no one knows how long he was out for, because it was only when the defense lawyer asked to approach that people realized the judge was out.

Fortunately for Sobrino, his lawyers Eric Schwartzreich and Michael Finesilver did not ask for a mistrial, most likely sensing that the ultimate not guilty verdict was on its way …

      I think people care about Diaz. A judge falling asleep in the middle of a trial involving police misconduct!? What the heck is wrong? If he can’t handle sitting through a trial he needs to quit. If he doesn’t quit- quiver runs against him can use this as a reason to retire him.

          The only thing I can say about Diaz is that he’s never been the brightest bulb on the bench. I guess that’s something considering the rest of the dimwits.
          It’s time he devote himself full time to something else besides snooze time.

    Maybe Diaz should focus less on extra curriculum activities and save his energy for being a Judge. Short of being able to stay awake at his publicly funded job, he should curtail his moonlighting. He’s no spring chicken afterall.

    A few things come to mind.

    1 is, none of this is funny.

    2 is, how can a higher court judge handling the most complex case not be aware of a federal holiday or the significance of the one in question.

    3 is, how is a judge fit if he can’t stay awake on a major media case with highly disturbing video evidence and particularly, when the defendant is testifying.

    4 is, what will be done about concerns presented.

      Is a JQC complaint appropriate? Will anyone file it? A judge falling asleep mid trial shows he shouldn’t be presiding over cases. But sadly- I think nothing will be done. The media hasn’t even done a story on the judge sleeping in the middle of a police misconduct trial. This story would absolutely go viral. I cant believe no one has picked it up.

          I agree- it might not be willful- but it shows that he isn’t fit to be presiding over cases anymore. The media should really pick this up. The public should know that the judge presiding over a police misconduct case was asleep in front of the jury!
          I hope her realizes that it is time for him to retire after this.

      At the very least- they should move him. Have him just do traffic tickets or something that isn’t as important as a police misconduct case! It’s embarrassing to the judiciary.
