She’s going to Dennis Bailey’s current Foreclosure Division #11, and Bailey is taking Gundersen’s Family Division #41. As far as Raag Singhal’s coveted former Civil Division #21, it’s being babysat by Mark Speiser until the JNC fills the vacancy created by Singhal’s call-up to The Show, with Raag’s replacement now likely coming to Criminal to take over for whomever wins the behind the scenes wrestling match to win admission to 21 Club. Save the date!Gina Hawkins JQC trial is coming up, set for February 13th in the central courthouse. There’s been lots of back and forth on the docketing of this case, with former ASA Greg Lauer now a listed witness in support of what he categorizes as his former trial partner’s “playful actions.” All docs are found here

Busted! – Clerk’s employee Sheena White got indicted by the Feds, suspended without pay since January 3rd of this year. The Indictment is found here. It’s unknown at this time if the allegations have any type of connection to White’s employment responsibilities.

Jason Maraj, one of Brenda’s higher-ups at the Clerk’s Office, recently beat a felony gun rap, ably repp’d by courthouse go-to-guy Jeremy Kroll. The PC Affidavit is here, No Info’d by the SAO’s Alex Urruela back on December 13th. Kroll also represents former ASA Alim Babayev on pending DUI allegations before Bobby Diaz, with Zeb Goldstein defending Babayev against a civil auto negligence complaint stemming from the same alleged DUI incident …

Whose mother do I have to hire around here to get a nolle prosse? – that’s the bad joke going around the courthouse these days, after the SAO dropped some serious 1st degree felonies, and then refiled them. The cases had been in ASA Jeff Chukwuma’s name, while the defense attorney was his mom, Laura Chukwuma. Needless to say, Jeff wasn’t the ASA that dropped the cases, but the incidents have been the talk of the SAO, where morale is even lower than the usually normal all-time-low, due to the perceived closeness of Laura to Mike Satz.

We saw Jeff Marcus and Satz last week and asked if they knew anything about the matter, since it was our understanding that police officers involved in some of the cases may have been the first to make the stink that led to the refiles. Marcus and Satz were predictably uncommunicative, so we went to the SAO’s PIO later that day, who replied last Friday:

Here is the Broward State Attorney’s Office response to your questions:

As you know, cases are automatically assigned by the degree of felony and the seniority level of the prosecutors in each courtroom/division.

Assistant State Attorney Jeffrey Chukwuma was removing himself from cases where his mother was the attorney of record, as required. We recently discovered that while he was removing himself from those cases and giving them to other prosecutors to handle, his name was remaining on the case as the assigned prosecutor.

This was corrected after it was discovered and Mr. Chukwuma was counseled to officially have the cases reassigned to avoid any appearance of impropriety.

Among those cases were one case involving two co-defendants and a separate case involving one defendant. Those cases were randomly assigned to Judge Siegel’s division, where the defense attorney’s son is the lead prosecutor.

Because of the conflict of interest, another lead prosecutor from a different courtroom/division was asked to handle the above cases. That prosecutor was absent from court because of a missed flight and yet another prosecutor was asked to step in (at short notice) and handle the court hearings.

After speaking briefly with the defense attorney, the prosecutor was under the impression that charges were to be dismissed against all three defendants and that one of the three defendants had agreed to plead to one charge in exchange for time served.

Upon review, supervising prosecutors disagreed with the dropping (or nolle pros) of the charges against the three defendants and those charges were re-filed. Supervisors also disagreed with the disposition of the charge that had been pleaded out but it was not possible to re-file that charge.

Our prosecutors are continuing to review the matter.

All but 17-8678CF10A have been re-filed.

    Oh, Bill… You forgot to mention Chukwuma “reassigned” his mother’s cases to two ASAs who were very chummy with Chukwuma and his mother. You also failed to mention that he attempted to place the blame on his predecessor for the abhorrent plea deal that he, by proxy, gave to his own mother. Consciousness of guilt, one could argue.

      Everyone knows Public Defender Supervisors don’t do squat. That includes not having any caseloads. What they do do is provide a network of informers to report to Howie (when he even comes in) all the malcontents that are ripe for the picking. That makes up most of the office where everyone is overworked and underpaid except for the PD Supervisors who get paid the big bucks, some after entering the Drop Program and are back for still more.           I don’t agree with all that but I must say for him to devalue military service by putting it below good jobs or college is rather offputting to say the least. It may be a generational thing as those from the Vietnam era as Judge Tuter appears to be may hold views about the military that are still influenced from that controversial time. Its difficult to say what the issue is with his statement but he should issue a clarification because military service is a higher calling than any other service including legal service or being a police person or a student with the exception of those people studying to be public school teachers.

    Buddy, you give Howard too much credit. Howard is a politician and, like any politician, he has an agenda which he is just as crafty in advancing as any paid consultant. His appears to incorporate a real antipathy towards law enforcement and, in particular, our State Attorney, Mike Satz, who is retiring at the end of this year after more than forty (40) years of public service. For many of those years, Mr. Satz has endured a steady stream of criticism from Howard’s soap box. I suspect that Howard’s attitude towards law enforcement dates back to 1987 when, inebriated, he plowed his Cadillac into a parked police car. Howard was not a twenty-something who lost his way, but a well-known member of the Bar with the reputation of a flamboyant litigator – an officer of the court. Howard’s arrest was big news. So were the cocaine and prescription drugs found in his car and the charge that he somehow obtained a court order to retrieve drugs held in evidence – drugs he was alleged to have pocketed. You need connections, cunning and real chutzpah to pull that off – facts that were not lost on Jeff Marcus, Mr. Satz’s rather reserved chief assistant who prosecuted the case. Marcus had him dead to rights and wanted convictions and prison time, but with the aid of a very skillful defense attorney and a nod from a sympathetic judge, Howard pled to probation, avoiding felony convictions, prison time and being disbarred. I wonder if Howard thinks he got his break at age thirty-four (34) because he is white and was a member of the Bar or if he somehow deserved it as he argued back then. Two things we know for sure: (1) Howard has frequently accused the State and judges of disproportionately punishing minorities; (2) Howard is not a minority. Have you ever heard Howard cite his own case as an example of disproportionate punishment? Howard got another break when Al Schreiber, Broward’s Public Defender at the time, took pity on him and hired him as an investigator. Howard began cultivating his image as a defender of the downtrodden, eventually succeeding Mr. Schreiber as our Public Defender. Howard’s approach has certainly brought him much publicity and made him a bit of a local celebrity or, as you put it, garnered him a “ginormous” following many have been reluctant to take on – which brings me back to my original point. Buddy, you say Howard speaks truth to power. I would argue that: (1) what Howard speaks is his truth – that which is convenient to him; (2) that Howard is often the heavyweight in the fight and (3) that maybe you have a blind spot where he is concerned. You are spot-on though in one respect: Broward will miss Howard for the entertainment value.
